Distant Consumer Contracts

Abstract:

Cílem této diplomové práce je rozbor úpravy distančních spotřebitelských smluv tak, jak je v českém právním řádu zakotvena od účinnosti zákona č. 89/2012 Sb., občanský zákoník. V první části práce jsou řešeny otázky vývoje soukromoprávní ochrany spotřebitele v nejvýznamnějších právních řádech západní civilizace (Evropská unie a USA) a v České republice. Druhá část vysvětluje pojmy „distanční smlouva“ a „elektronická smlouva“. Ve třetí části, která je pojata obecně teoreticky bez ohledu na zvláštní spotřebitelskou úpravu, jsou řešeny obecné otázky distančního způsobu uzavírání smluv, jako je platnost a zachování písemné formy. Poslední část se zabývá výkladem ustanovení o distančních spotřebitelských smlouvách v novém občanském zákoníku s přihlédnutím k prováděným směrnicím Evropské unie.

Abstract:

The goal of this diploma thesis is to offer an interpretation of regulation of distance consumer contracts as it is contained in Act No. 89/2012 Coll., the Civil Code. The first part deals with the development of civil law consumer protection in most influential legal systems of western civilization (European Union and USA) and in the Czech Republic. Second part explains and defines terms such as “distance contract”, or “electronic contract”. Next part has more theoretical approach without consideration of special consumer protection, it deals with general issues of distance consumer contracts such as validity and preservation of written form. The final part deals with interpretation of the regulation of distance consumer contracts in civil code with consideration of European Union directives.
