Institutional Replacement: the Case of Replacing The United Nations Commission on Human Rights by the Human Rights Council

Abstract:

Cílem této práce je nabídnout jednu z možných odpovědí na otázku, proč dochází k nahrazování mezinárodních institucí. Nabízená odpověď je formulována na základě otestování hypotéz vycházejících ze tří hlavních teoretických přístupů ke studiu mezinárodních institucí – realismu, neoliberalismu a konstruktivismu. Ty jsou testovány na případu nahrazení Komise Organizace spojených národů (OSN) pro lidská práva Radou OSN pro lidská práva, který je nejprve za užití jedinečné případové studie detailně a zcela oproštěně od jakékoliv předchozí znalosti relevantních teorií popsán. Mezi klíčové závěry práce patří zjištění, že k nahrazení Komise Radou došlo především v důsledku konání Světového summitu a nikoliv vlivem její přílišné politizace či jednostranného rozhodnutí USA a že celý proces nahrazování Komise nejlépe vyhovuje hypotézám vycházejícím z konstruktivismu a modelu bodu zvratu či kritického mezníku.

Abstract:

The aim of this thesis is to offer an answer to the question, why international institutions are being replaced. The proposed answer is formulated on the basis of testing of hypotheses derived from the three main theoretical approaches to the study of international institutions – realism, neoliberalism and constructivism. These are tested against the case of the replacement of the United Nations (UN) Commission on Human Rights by the UN Human Rights Council, which is previously described, without applying any theoretical pre-understanding, using a unique case study. Among the key findings of this thesis several inferences are conveyed – that the Commission was replaced mainly due to the need to produce some results during the World summit and not because of its politicization or as a result of a unilateral decision of the United States of America and that the whole process of replacing the Commission can be best explained using the constructivist hypotheses and the model of a tipping point.
