Abstract:

Tato diplomová práce z oblasti veřejných zakázek se zabývá problematikou povinností zadavatele ve vztahu k nabídkovým cenám se zaměřením na fázi před hodnocením nabídek. Podstatná část práce je věnována posouzení cenových odchylek v nabídce, zejména pak nulové nabídkové ceně a institutu mimořádně nízké nabídkové ceny, přičemž je zde nastíněn mechanismus jeho určování. Teoretické části práce jsou podloženy rozborem související judikatury a rozhodovací praxe, u níž je akcentována právě problematika povinností zadavatele ve vztahu k nabídkovým cenám se zaměřením na fázi před hodnocením nabídek.

Abstract:

This Master´s thesis from the field of public procurement deals with the obligations of the contracting authority in relation to the tender prices with a focus on pre tender evaluation. A substantial part of the work is devoted to the assessment of price variations on offer, particularly the zero tender price and the institute of abnormally low tender price, while there is a mechanism outlined its determination. The theoretical parts of the thesis are based on an analysis of the relevant case law, in which it emphasized precisely the obligations of the contracting authority in relation to the tender prices with a focus on pre tender evaluation.
