Proceedings in the Matters of Children under 15 under the Juvenile Justice Act

Abstract:

Tato diplomová práce pojednává o řízení v případech protiprávní činnosti dětí mladších 15ti let podle zákona č. 218/2003 Sb., o soudnictví ve věcech mládeže, ve znění pozdějších předpisů, který je účinný od 1.1.2004. Práce popisuje a hodnotí postup od spáchání činu jinak trestného dítětem mladším 15 let až po stěžejní část práce, postup před soudem a uložení opatření za tento čin. V úvodu práce jsou rozebrány pojmy související s tímto řízením a souvislost samotného zákona o soudnictví ve věcech mládeže s jinými právními předpisy. Práce dále vymezuje ukládaná opatření dle platné právní úpravy a závěr práce patří zhodnocení a východiskům de lege ferenda.

Abstract:

This dissertation is dealing with proceedings in case of illegal activity of children under the age of fifteen according law no. 218/2003 collection about jurisprudence in the matter of children as amended, efficient since 1st of January 2004. This thesis is describing and evaluating procedure from commission of otherwise criminal act by the child under the age of fifteen to a crucial part of thesis, procedure at trial and imposing precaution for this act. At the begining of the dissertation there are analysed fundamental concepts that are related with this proceedings and connection between the law about jurisprudence in the matter of children and other legislation. The thesis is further defining the imposing precautions according valid legal modification and the end of the thesis goes to evaluation and de lege ferenda resources.
