Contracting in esports

Abstract:

Diplomová práce se bude zabývat kontraktací a smlouvami v oblasti espor-tu, jejich vymezením, představením specifik, a to včetně mezinárodního přesahu. Teoretická část práce bude identifikovat v úvodu relevantní sub-jekty, které v těchto vztazích figurují a dále je rozebírat. Na základě identi-fikovaných subjektů se práce bude dále věnovat analýze smluvních specifik z hlediska účinné české právní úpravy. Ve zvláštní části práce budou roze-brána specifika jednotlivých esportových smluv, mj. pracovních smluv a tzv. sportovních smluv, práce se ale také zaměří na další smluvní typy a pod-mínky. Cílem práce tak bude analýza charakteristik esportových smluv, jejich právních specifik a dále vzhledem k často přítomnému mezinárodní-mu prvku dopady v rámci mezinárodního práva soukromého, včetně pří-padných doporučení vyplývajících ze zjištěného. Při psaní práce bude diplomant vycházet ze souvisejících unijních i ná-rodních právních předpisů, českých i zahraničních odborných publikací, pri-oritně komentářové literatury, akademických článků a případně dostupné judikatury. Práce je aktuální k datu 30. 6. 2023.

Abstract:

The thesis will deal with contracting and contracts in the field of esports, their definition, introduction of specifics, including internatio-nal overlap. The theoretical part of the thesis will identify in the intro-duction the relevant sub-entities that figure in these relationships and further analyze them. On the basis of the identified subjects, the thesis will further analyse the contractual specifics in terms of the effective Czech legislation. In a separate part of the thesis, the specifics of indi-vidual esport contracts will be analysed, including employment con-tracts and so-called sports contracts, but the thesis will also focus on other contractual types and sub-conditions. The aim of the work will be to analyse the characteristics of esport contracts, their legal speci-fics and, given the often-present international element, the implications for private international law, including possible recommendations ari-sing from the findings. In writing the thesis, the graduate will draw on relevant EU and national legislation, Czech and foreign publications, primarily commen-tary literature, academic articles and, where appropriate, available ca-se law. The thesis is current as of 30 June 2023.
