Euthanasia as an Issue of Criminal Law in a Contemporary Society

Abstract:

Každý stát se k eutanazii staví po svém, ale jen málokterý kladně. Výsledkem je proto zpravidla trestněprávní odpovědnost toho, kdo by eutanazii vykonal, popř. by jen asistoval u sebevraždy jiné osoby. Česká republika je, pokud jde o právní úpravu problematiky eutanazie, i přes legislativní snahy z posledních let poněkud pozadu oproti vyspělým státům nejen ze starého kontinentu. Právě pokusy o zohlednění problematiky eutanazie do českého právního řádu z posledních let mne přivedly k tématu „Eutanazie jako trestněprávní problém moderní společnosti“. Cílem práce je nejen podat trestněprávní analýzu problematiky eutanazie, resp. asistované sebevraždy z pohledu české právní úpravy, ale také poskytnout přehled řešení v zahraničních právních úpravách, které mají s rozebíranou problematikou mnohem větší zkušenosti. Mým záměrem bylo dodržet trestněprávní charakter práce. Přesto je její nezbytná část věnována rozboru terminologie, která není jednotná ani v odborných kruzích. V kapitole věnované odborným i neodborným názorům na otázku eutanazie pak práce nabízí stručný přehled postojů lékařů, právníků, politiků, ale také laické veřejnosti k rozebírané problematice. Stěžejními metodami, kterých bylo při psaní této diplomové práce použito, jsou metody analytická a monografická. Dále bylo použito metody komparativní a historické. Eutanazie jako taková je legální pouze v Beneluxu a díky judikatuře i v Japonsku. V Ostatních státech je provádění eutanazie ilegální, ale přece jen se lze povětšinou setkat s privilegovanou skutkovou podstatou usmrcení na žádost, popř. usmrcení ze soucitu, čímž dochází ke zmírnění trestního postihu pachatele. Domnívám se pak, že platný český trestní zákoník i přes ztroskotání snahy privilegovat skutkovou podstatu usmrcení na žádost, přece jen poskytuje prostor pro zmírnění trestněprávního dopadu eutanazie.

Abstract:

The theme of euthanasia is a highly controversial and discussed topic all over the world and almost each country is forced to address it. Practically every developed country has its own way how to deal with the issue of euthanasia and assisted suicide. Euthanasia is illegal in most developed countries, being currently legal only in the Netherlands, Belgium, Luxembourg and Japan. Assisted suicide can be, on the other hand, carried out with no criminal impact in higher number of states in the developed world. Euthanasia and assisted suicide are in certain countries dealt with through provisions of manslaughter with limited criminal liability, when committed at definite request or out of compassion. Euthanasia is illegal also in the Czech Republic and the Czech law pays much lower attention to the issue of euthanasia or assisted suicide than laws of other developed countries. There have been numerous attempts to change such an unsatisfactory situation which made me choose the topic “Euthanasia as an issue of criminal law in a contemporary society” for my thesis. The main aim of my thesis is not only to thoroughly analyze the current situation around the issue of euthanasia in the Czech Republic. Another main aim is to provide readers with a comprehensive overview of possible treatment of this issue applicable in laws of certain other developed countries. I tried to avoid the general parts in my thesis, though an explanation of the basic terminology, provided in the chapter one, was necessary in order to maintain the quality of the issue analysis. Another chapter of my thesis contains summary of public opinion and opinions of well-known and recognized physicians, politicians and lawyers on the issue of euthanasia. The chapter six of my thesis is devoted to one of the most known case in the area of euthanasia at all – the case of Mrs. Diane Pretty. The reader of my thesis is thus provided with important arguments but left to conclude himself whether it would be the best choice to legalize euthanasia or not.
