Abstract:
Diplomová práce se zaměřuje na vybrané problémy aplikace uznání dluhu. První část práce se věnuje uznání dluhu nezpůsobilým započtením. Další část se věnuje myšlence vyhrazení účinku domněnky existence závazku pro výslovné uznání dluhu a úvahám de lege ferenda. The thesis focuses on selected issues of the application of acknowledgement of debt. The first part of the thesis deals with the acknowledgement of debt by ineligible set-off. The next part is devoted to the idea of reserving the effect of the presumption of the existence of the obligation for the express acknowledgement of debt and de lege ferenda considerations.
