Regulation of Payment Services in the Czech Republic

Abstract:

Diplomová práce se zabývá regulací platebních služeb na území České republiky. Poskytuje ucelený pohled na právní úpravu platebních služeb v České republice včetně porovnání s úpravou obsaženou v právu Evropské unie. Diplomová práce se zejména věnuje zákonu o platebním styku účinnému od 13. ledna 2018, který byl přijat z důvodu transpozice směrnice PSD2. Diplomová práce obsahuje vymezení jednotlivých platebních služeb a také taxativní výčet služeb či činností, které zákon o platebním styku za platební služby nepovažuje a jsou vyjmuty z působnosti zákona. Součástí diplomové práce je charakteristika subjektů, které jsou oprávněny poskytovat platební služby dle zákona o platebním styku, tj. platební instituce, poskytovatele služeb malého rozsahu, instituce elektronických peněz a vydavatele elektronických peněz malého rozsahu. Detailněji je popsána úprava správce informací o platebním účtu včetně požadavků pro získání povolení. Ve čtvrté části diplomové práce jsou definovány nové platební služby, a to služba nepřímého dání platebního příkazu a služba informování o platebním účtu. V závěrečné části je uvedeno zhodnocení přínosů nových platebních služeb, s ohledem na jejich praktické využití.

Abstract:

This thesis deals with the regulation of payment services in the Czech Republic. It provides a comprehensive view of the legislation on payment services in the Czech Republic, including a comparison with that contained in European Union law. The thesis deals mainly with the Payment System Act effective from 13 January 2018, which was adopted due to the transposition of the Payment Services Directive 2. The next part of the thesis defines individual payment services and also the enumerative list of services or activities that are not considered by the Payment System Act as payment services and are thus excluded from the scope of the Act. Furthermore, this thesis includes the regulation of entities authorized to provide payment services under the Payment System Act, ie payment institutions, small-scale service providers, electronic money institutions and small-scale electronic money issuers. The regulation of the Payment Account Information Manager including the requirements for obtaining authorization is described in more detail. In the fourth part of the thesis new payment services are characterized, namely the Payment Initiation Service and the Account Information Service. In the final part, there is an evaluation of the benefits of new payment services with regard to their practical use.
