Cryptocurrencies in the context of legal regulation in Czech republic & their taxation

Abstract:

Diplomová práce se zaměřuje na historický legislativní vývoj virtuální měny, tzv. kryptoměny, na území České republiky, s jednotlivými odkazy na právní úpravu této problematiky ve světě. Akcentuje též zlato jako podstatného hybatele společnosti při vývoji zlatého standardu a jeho postupnou regulaci v oběživu. Zároveň se odráží od zlata jako podkladového aktiva, které bylo dlouhá tisíciletí spjato se světovou měnou. V první části se zaobírá vývojem peněz a jeho klíčových vlastností. Další část je zaměřena na historickou genezi vývoje Česko-slovenského oběživa a zároveň naráží na podobné rysy a hodnoty, které jsou přivlastňovány zlatu. Třetí a čtvrtá část se zabývá výkladem základních pojmů a naráží na předchůdce kryptoměn a jejich definici. Grós práce je obsaženo v části páté a šesté, které reflektuje legislativní změny v České republice a ve světe. Reaguje na postupný vývoj v ČR i zahraniční scéně s odkazem na tradiční měny. Zdanění digitální měny je řešeno v předposlední části jako vedlejší dílčí téma. Závěrečný oddíl je věnovaný samostatné realizaci nákupu Bitcoinu.

Abstract:

This thesis focuses on historical legislative development of virtual currency - cryptocurrency in the Czech Republic with particular references to the legal regulation of these aspects in the world. It emphasizes gold as a significant driver of society in the development of the gold standard and its gradual regulation in circulation. Simultaneously, it is based on gold as an underlying asset that has been associated with the world currency for millennia. The introductory part addresses the development of money and its key features. The next part is focused on the historical genesis of the development of the Czech-Slovak currency in circulation as well as it encounters similar characteristics and values which are usually attributed to gold. Next two sections deal with definitions of basic notions and describe cryptocurrency predecessors and their fundamental concepts. The core of thesis is covered by the chapters 8 and 9 reflecting the legislation changes regarding cryptocurrencies, both in the Czech Republic and in the world. It responds to the gradual development on the Czech and foreign scene with reference to traditional currencies. The penultimate part addresses the cryptocurrency taxation. The final section is dedicated to the actual purchase of Bitcon.
