Termination of employment by notice of termination

Abstract:

Tématem této práce je skončení pracovního poměru z iniciativy zaměstnavatele, konkrétně výpovědí z důvodu nadbytečnosti v důsledku organizačních změn. Cílem práce je analyzovat, za jakých podmínek je možné ukončit pracovní poměr z důvodu nadbytečnosti zaměstnance v České republice a Nizozemí za účelem tyto úpravy porovnat. V práci jsou nejprve shrnuty nejdůležitější koncepční změny, ke kterým došlo v souvislosti s rekodifikací občanského zákoníku, charakterizován institut pracovního poměru, jeho vznik a zánik. Poté je věnována pozornost výpovědi ze strany zaměstnavatele z pohledu obecně hmotněprávních podmínek platnosti výpovědi. Stěžejní části práce je právní rozbor výpovědi z důvodu nadbytečnosti a to z pohledu české a nizozemské právní úpravy. Následující kapitoly se zabývají zákazem výpovědi dané zaměstnavatelem a povinnostem zaměstnavatele v souvislosti se skončením pracovního poměru. V závěrečné kapitole je provedena komparace a shrnuty zásadní rozdíly české a nizozemské právní úpravy spolu s náměty de lege ferenda.

Abstract:

The main subject of this thesis is termination of an employment relationship by initiative of the employer, specifically notice of redundancy due to organizational changes. The aim of this thesis is to analyze the conditions under which it is possible to terminate the employment due to redundancy both in Czech Republic and in the Netherlands in order to compare these legislations. First, there is a brief summary of the most important conceptual changes that have occurred in connection with the recodification of the Civil Code, characterized an institute of the employment relationship, its establishment and termination. Then, the attention is given a notice by the employer in terms of the general substantive conditions of termination. The fundamental part is a legal analysis of redundancy dismissals from the perspective of Czech and Dutch legislations. The subsequent chapters deal with the prohibition of dismissal of the employer and the duties of the employer in relation to termination of employment. In the final chapter major differences of Czech and Dutch legislations are compared and summarized, along with suggestions de lege ferenda.
