Sentence of Banishment and Administrative Banishment in Mutual Comparison

Abstract:

Práce je členěna do devíti kapitol v nichž jsem se snažil učinit stručný exkurz do problematiky vyhošťování cizinců z našeho území. Po úvodu a vysvětlení základních pojmů jsem se zaměřil na výklad práva na svobodu pohybu a pobytu ve smyslu českého ústavního práva, dále pak obecnému výkladu trestu vyhoštění a správního vyhoštění a jejich bližší specifikaci ve vztahu k jednotlivým pobytovým povolením cizinců. V páté - stěžejní části své práce se věnuji tématům, týkajících se aplikace obou těchto sankcí v praxi včetně faktorů, které musí aplikující orgány zvážit před jejich uložením, jako jsou např. překážky vycestování, probíhající řízení o udělení azylu či možný zásah do soukromého a rodinného života. Do této kapitoly jsem zahrnul i problematiku upravující důvody, příčiny a okolnosti, se kterými naše právo spojuje zrušení, zmírnění či nemožnost uložení obou sankcí. Práce je zakončena mým pohledem na možné budoucí změny v oblastech, které se týkají trestu vyhoštění a správního vyhoštění v zákoně o pobytu cizinců na území České republiky, trestním zákoně a trestním řádu. Nechybí však ani závěr, cizojazyčné resumé a seznam použité literatury a dalších pramenů.

Abstract:

I have devided my thesis into 9 chapters where I have tried to create a sententious excurcus into the problems of banishment of the foreigners from the Czech Republic. After writing the introduction and explanation the main ideas I have focused on defining the right of freedom of movement and stay in accordance with the Czech constitutional law, general definition of the punishment of deportation and the administrative deportation and their further specifications concerning the individual residence permit of the foreigners. In the fifth chapter, which is the most important one, I have paid attention to the themes relating with the application of both of these sanctions practically. I have also included the factors which have to be considered by the applying authorites before imposing the sanctions. The factors can be the difficulties with emigration, proceeding possibility of being given asylum or the eventual invasion of private and family life of the foreign person. In this chapter I have also included the dilemma which is alterring the reasons, causes and circumstances that are according to our law connected with the cancellation, modulation or restraint of imposition of both of the sanctions. I have concluded my thesis by my own opinion on the possible future changes in the fields which are connected with the punishment of deportation and the administrative deportation in the law concerning the staying of the foreigners in the Czech Republic teritory, penal law and in the Rule of Criminal Procedure. I have also included the closing, the foreign-language résumé and the list of bibliography.
