Good manners as a corrective of contractual freedom

Abstract:

Cílem této diplomové práce je objasnit funkci dobrých mravů ve spojitosti se smluvní autonomií, kde působí jako její korektiv. První část práce je zaměřena na vymezení pojmu "dobré mravy". Druhá část práce je věnována pojmu "smluvní svoboda", kde jsou rozebrány také její dílčí projevy. Třetí část práce se zabývá historií a vývojem dobrých mravů v různých časových obdobích. Čtvrtá část této práce se věnuje srovnání dobrých mravů s jinými korektivy, konkrétně srovnání s morálkou, dobrou vírou a spravedlností. Předposlední část práce je zaměřena na vymezení vzájemného vztahu dobrých mravů a autonomie vůle. Poslední část práce je věnována dobrým mravům v různých oblastech práva, zejména v dědickém právu a institutu náhrady škody.

Abstract:

The aim of this diploma thesis is to clarify the function of good morals in connection with contractual autonomy, where it acts as its corrective. The first part of the thesis is focused on the definition of the term "good morals". The second part of the thesis is devoted to the concept of "freedom of contract", where its partial manifestations are also analyzed. The third part of the thesis deals with the history and development of good manners in different time periods. The fourth part of this thesis deals with the comparison of good morals with other corrections, specifically the comparison with morality, good faith and justice. The penultimate part of the thesis is focused on defining the mutual relationship of good morals and autonomy of will. The last part of the thesis is devoted to good morals in various areas of law, especially in inheritance law and the institute of damages.
