Legal Regulation of P2P Lending in the Czech Republic

Abstract:

Práce se zabývá novým společenským jevem ve formě tzv. P2P úvěrování. Autor nejprve podává popis tohoto jevu, uvádí mezinárodní kontext, aby nakonec mohl představit samotné P2P úvěrování v České republice. Cílem práce je zjistit, jaká právní regulace se aplikuje specificky pro P2P úvěrování v podmínkách právního řádu České republiky a zjistit důvody pro takovou aplikaci, případně neaplikaci. Není opomenut zákon o platebním styku, zákon o spotřebitelském úvěru, zákon o investičních společnostech a investičních fondech či zákon o podnikání na kapitálovém trhu. V rámci zhodnocení nynějšího stavu jsou navrženy také smluvní nebo zákonné změny, které by bylo vhodné učinit v případě rizikových situací vyplývajících ze vztahů mezi účastníky P2P úvěrování. Zdanění zisku z investic není též opomenuto. Je proto provedena daňová klasifikace příjmů investorů.

Abstract:

The thesis deals with a new social phenomenon in a form of so called P2P lending. The author first gives a description of this phenomenon, presents the international context, so he could eventually present the P2P lending in the Czech Republic itself. The objective of the thesis is to find out which legal regulation is specifically applied to the P2P lending under the conditions of the legal system of the Czech Republic and to find out the reasons of such application, alternatively nonapplication. The Payment System Act, Consumer Credit Act, Management Companies and Investments Funds Act or Capital Market Undertakings Act is not ignored. Also, within assessment of the current state, it is proposed to make contractual or statutory changes in case of hazardous situations arising from relations between parties to the P2P lending. Taxation of the profit from the investments is not omitted, too. Therefore, the tax assessment of the income of the investors is carried out.
