Banking Law within the Non-fiscal Part of Financial Law

Abstract:

Diplomová práce se ve své první části zabývá teoretickým zařazením bankovního práva v rámci finančního práva, resp. nefiskální části finančního práva. Přitom nastiňuje prolínání soukromoprávních a veřejnoprávních institutů v této oblasti práva. Druhá část je věnována detailnějšímu výzkumu institutu pojištění pohledávek z vkladů, a to nejen v intencích analýzy historického vývoje a současné podoby právní úpravy na úrovni Evropské unie a vnitrostátního práva České republiky, nýbrž i se zohledněním vlivu institutu na finanční stabilitu bankovního, resp. finančního trhu. Proto je v rámci celé práce využito multidisciplinárního přístupu osvětlujícího ekonomickou podstatu, účel a souvislosti bankovního práva a jeho institutů.

Abstract:

In its first part the thesis deals with the theoretical classification of banking law within the framework of financial law, non-fiscal part of financial law respectively. It outlines the permeation of private and public law institutes in this area of law. The second part is devoted to a more detailed research of the deposit insurance institute, not only in terms of the analysis of the historical development and the current form of legal regulation at the level of the European Union and the national law of the Czech Republic but also with regard to the influence of the institute on the financial stability of the bank market and financial market. Therefore, a multidisciplinary approach is used to illustrate the economic nature, purpose and context of banking law and its institutes.
