The Rights of the Person Inspected by an Administrative Supervisor

Abstract:

Tématem této bakalářské práce jsou Práva kontrolované osoby při správním dozoru. V teoretické části bakalářské práce se v první kapitole věnuji nejprve vysvětlení základních teoretických pojmů, které úzce souvisí s tématem mé bakalářské práce. V první části jsem vymezila stěžejní pojmy, kterými jsou kontrola a dozor a včetně uvedení jejich rozdílů. Ve druhé kapitole bakalářské práce popisuji ze svého pohledu správní dozor, u kterého jsem uvedla jeho druhy a také jednotlivé fáze. Ve třetí kapitole bakalářské práce jsem se zaměřila obecně na právní vztahy při správní dozoru, kapitola obsahuje specifikaci samotných práv a povinností kontrolovaných osob a závěrečná část kapitoly je ponechána oprávněním a povinnostem dozorčích orgánů včetně krátkého pojednání o ukládání sankcí. V praktické části, práce se pak zabývám výzkumem, který je postaven na vybraných rozhodnutích Krajských soudů. Jako cíl mého výzkumu jsem si stanovila zjistit, která práva jsou v rámci správního dozoru nejčastěji porušována a poté pomocí komparace vybraných rozsudků, dojít k rozdílným znakům daných případů.

Abstract:

The topic of this bachelor thesis is focused on the rights of the Person inspected by an administrative supervisor. In the theoretical part of the bachelor thesis, the first chapter is devoted to the explanation of basic theoretical terms which are closely related to the topic of my bachelor thesis. In the first part, I have defined the key concepts of control and supervision, including their differences. The second chapter of my bachelor thesis includes my views of the administrative supervision,specifik its types and individual phases.. The third chapter of my bachelor thesis is focused on legal relations in administrative supervisit with focus on the specification of the rights and obligations of the inspected persons and on tge powers and duties of the supervisory bodies, including a brief treatise on the imposition of sanctions,in its final part. The practical part deals with my research based on selected decisions of the County Court. The objektive of my research, has been to determine which rights are the most commonly violated in administrative supervisit and then, by comparing selected judgments, the different features of the given cases.
