Expertising of the Health Conditions for the Purpose of Social Security

Abstract:

Tato práce je zaměřena na problematiku posuzování zdravotního stavu v systému sociálního zabezpečení. Zabývala jsem se jednotlivými oblastmi systému práva sociálního zabezpečení, v nichž se lze setkat s posuzováním zdravotního stavu občana. Jedná se především o systém nemocenského pojištění, důchodového pojištění, státní sociální podpory a sociální pomoci. Svou pozornost jsem zaměřila na jednotlivé instituty, kde posuzování zdravotního stavu hraje významnou roli. Patří mezi ně dočasná pracovní neschopnost osoby, která je spojena s dočasným omezením vykonávat zaměstnání. Dále je to invalidita, která trvale ovlivňuje život osoby v různé míře podle odlišného stupně postižení. Dalším je závislost na péči jiné osoby. S posuzováním zdravotního stavu se setkáváme i u zdravotního postižení. V další části práce jsou popsány orgány, které provádějí samotné posuzovaní zdravotního stavu osoby, mezi které se řadí ošetřující lékař, lékařská posudková služba a také posudkové komise ministerstev. Na ně navazují orgány, které působí v rámci správního řízení a jsou kompetentní k rozhodnutí o odpovídající dávce ze systému sociálního zabezpečení vzhledem k zdravotnímu stavu dané osoby. Cílem mé práce bylo zmapovat systém práva sociálního zabezpečení, jeho oblasti, v nichž dochází k posuzování zdravotního stavu a na jeho základě pak k řízení a rozhodování o odpovídajícím plnění z příslušného systému.

Abstract:

This thesis is aimed et the problem of assessing health status in the social security system. I focused on different areas of social security regulations, which are concerned with assessing the health of citizens – namely of system of health insurance, pension insurance, government social support and social assistance. I focused my attention on the individual institutions where health assessment takes an important part.These include temporary incapacity of the person which is associated with a temporary restriction to perform the job. Then there is a disability that permanently affects the lives of people to varying degrees according to different degrees of disability. Another is dependency on care of another person. We also encounter assessment of health status in medical insurance. The next section describes the bodies that perform the actual assessment of health status of a person, namely the attending physician, Medical Assessment Service and Assessment Commission of the Ministries. Subsequent bodies working in the administrative proceeding are competent to decide on the appropriate allowance from the social security system according to the health status of a person. The aim of my thesis was to map the social security system, the areas of health assessment and connected management and decision-making on the appropriate benefit from the system.
