The Legitimacy of the Court of Justice of the European Union

Abstract:

Soudní dvůr Evropské unie si během své existence vybudoval roli aktéra s významným vlivem, jenž má potenciál ovlivňovat i politické směřování Evropské unie. Tyto tendence neunikly akademikům, kteří se legitimačnímu základu Soudního dvora Evropské unie začali věnovat ve svých studiích. Předkládaná bakalářská práce na téma Legitimita Soudního dvora Evropské unie se zaobírá dosavadním výzkumem v oblasti legitimity unijního soudnictví formou literární rešerše. Cílem práce je komplexně zhodnotit dosavadní výzkum legitimity Soudního dvora Evropské unie s důrazem na vymezení jednotlivých konceptů legitimity. Stěžejní součástí práce je kritické zhodnocení jednotlivých studií, na jejichž základě budou vymezeny návrhy na další inovativní výzkum.

Abstract:

The Court of Justice of the European Union during its existence has become a major actor with significant influence, which has potential to affect the political direction of the European Union. These tendencies were noticed by experts who began to research legitimacy basis of the Court of Justice of the European Union. The bachelor thesis named The Legitimacy of the Court of Justice of the European Union deals with current research in the field of EU judicial legitimacy as a literature review. The main objective of the thesis is to summarize and critically evaluate results of existing research dealing with the legitimacy of the Court of Justice of the European Union, with an emphasis on identifying the different concepts of legitimacy. The fundamental part of the work is a critical evaluation of existing research and formulation of new research questions and proposals as a ground for further innovative research.
