The Social Housing as a Human Rights Issue

Abstract:

Tato diplomová práce je věnována pohledu na sociální bydlení z hlediska závazků týkajících se naplňování práva na bydlení, které vyplývají z mezinárodních úmluv a dokumentů. Jsou analyzovány úmluvy a dokumenty OSN, Rady Evropy, Evropské unie a také relevantní judikatura jihoafrického Ústavního soudu a indického Nejvyššího soudu. Práce rozebírá také aktuální problémy ochrany práva na bydlení v České republice, navrhované koncepce sociálního bydlení a přináší návrhy legislativních změn, které by měly přispět ke zlepšení naplňování závazků vyplývajících z mezinárodního práva.

Abstract:

The topic of this thesis is social housing from the point of view of obligations that arise from the international human rights treaties and documents which refer to the right to housing. It analyzes relevant UN treaties and documents, instruments of the Council of Europe, EU law and relevant judgments of the Constitutional Court of South Africa and Supreme Court of India. It also examines current issues that impact the protection of the right to housing in the Czech Republic and various proposed social housing strategies. Finally, it suggests changes to the existing legislation to be in compliance with the requirements of international human rights law.
