Legal regulation of the purchase contract according to the new directive on consumer rights and its' application

Abstract:

Předmět této práce je omezen na nově vzniklou právní úpravu a její vztah k politice ochrany spotřebitele vedené Evropskou unií a prosazované na území jednotlivých členských států. Cílem této práci je prozkoumat novou účinnou směrnici o právech spotřebitele, která upravuje vztahy mezi prodejcem zboží/poskytovatelem služeb a spotřebitelem. Jako dílčí cíl bych chtěla ukázat na dosavadní problémy v případě soudních sporů a zohlednit očekávající nabytí platnosti nové právní úpravy EU týkající se oblasti ochrany spotřebitelů.

Abstract:

The subject of this work is limited to the newly established legislation and its relation to consumer protection policy led by the European Union and enforced on the territory of member states. The aim of this work is to explore a new directive on consumer rights, which governs relations between the seller of goods / service provider and the consumer. As a partial goal, I would like to show current problems in case of lawsuits, taking into account new coming EU legislation on consumer protection.
