Protection of the Olympic symbol, flag, motto and anthem

Abstract:

K neoprávněnému užívání olympijské symboliky dochází v České republice na různých úrovních a v různé míře závažnosti. V 70 % všech zkoumaných případů se nelegálního použití olympijské symboliky ve sledovaném období dopustily nekomerční subjekty. Díky důslednému monitoringu a citlivému přístupu se Českému olympijskému výboru (ČOV) vždy podařilo zamezit pokračování sporných situací. Zvláštní kategorii tvořily konflikty, jejichž přímými aktéry byli sportovci – účastníci olympijských her. Aby se ČOV v budoucnosti vyvaroval krajního řešení v podobě vyloučení závodníka z účasti na olympijských hrách, musí věnovat speciální pozornost precizní přípravě smluv o účasti na hrách, které se sportovci podepisuje. Nové zkušenosti sbírá ČOV s přibývajícími případy porušení pravidel obchodními společnostmi. V této oblasti u nás dochází ke shodnému vývoji jako v zahraničí, tedy k posunu k čím dál promyšlenějším pokusům aplikovat tzv. skrytý marketing. V současnosti je ČOV účastníkem několika soudních sporů, jejichž výsledek ukáže, jakým směrem se bude ubírat politika ČOV na poli ochrany olympijské symboliky v příštích letech. Z běžné praxe bude ČOV vycházet i při přípravě kandidatury hl. města Prahy na letní olympijské hry v roce 2016.

Abstract:

In the Czech Republic unauthorized use of Olympic symbols occurs on different levels and at a different rate of relevancy. In 70% of all surveyed cases it was by non-commercial enterprises that illegal application of Olympic symbols had been committed in the period under examination. Due to its consistent monitoring and a sensitive approach, the Czech National Olympic Committee has always succeeded in preventing resumption of such controversial matters. A specific category was constituted by conflicts in which athletes themselves – participants in the Olympic Games – were involved. In order to avoid such extreme solution that is excluding the competitor from the participation in the Olympic Games in the future – the Czech NOC must pay a special attention to precise preparation of contracts which is about to enter with athletes – on their participation in the Games. The Czech NOC is gathering new experience with the increasing number of cases where violation of the rules appears on behalf of commercial companies. In this field, in our country a similar development to that, which is happening abroad, is coming, i.e. towards more and more well-thought-out attempts to apply the so called ambush marketing. At present, the Czech NOC is a participant in several lawsuits whose result will show in which way the Czech NOC’s policy will go on the field of protection of the Olympic symbols within the next years. The Czech NOC will proceed from long years of its practical experience also in case of preparations for the candidature of the City of Prague for the summer Olympic Games in 2016.
