Discrimination based on sexual orientation and gender identity as an issue in international relations

Abstract:

Tato diplomová práce se zabývá problematikou ochrany osob diskriminovaných na základě jejich sexuální orientace a/nebo jejich genderové identity (SOGI), a to na globální úrovni. Cílem práce je jednak vystihnout průběh mezinárodních diskuzí na téma LGBTI práv a diskriminace za základě SOGI a jednak zhodnotit činnost nezávislého experta OSN na ochranu proti násilí a diskriminaci na základě SOGI. Práce zkoumá problematiku zejména na úrovni OSN, kde představuje konkrétní mechanismy, které se tímto tématem zabývají, uvádí relevantní principy mezinárodního práva aplikovatelné na problematiku LGBTI práv a předkládá příklady porušování práv LGBTI osob v současném světě. Mimo jiné se také pokouší nahlédnout na problematiku lidských práv optikou práv LGBTI osob a provádí analýzu na základě (ne)dodržování zpravodajské povinnosti vybraných států u jednotlivých výborů OSN. V neposlední řadě se práce také věnuje zmiňovanému postu nezávislého experta a zkoumá jeho činnost a roli v ochraně práv LGBTI osob.

Abstract:

This thesis focuses on the protection of people discriminated against because of their sexual orientation and / or gender identity (SOGI) – at the global level. The aim of the thesis is to describe the course of international discussions on LGBTI rights and discrimination based on SOGI and to evaluate the activities of the independent UN expert on protection against violence and discrimination based on SOGI. The thesis examines the issue especially at the UN level, where it identifies specific mechanisms that deal with this topic, summarizes the relevant principles of international law applicable to the issue of LGBTI rights and presents examples of violations of LGBTI rights in today's world. Among other things, it also tries to look at the issue of human rights from the perspective of the rights of LGBTI people and performs an analysis based on (non)compliance with the reporting obligations of selected states to individual UN treaty bodies. Last but not least, the thesis also analyses the above-mentioned position of independent UN expert and examines his activities and overall role in protecting the rights of LGBTI people.
