Nuclear Weapons Nonproliferation Regime: Challenges and Future

Abstract:

Disertační práce „Režim nešíření jaderných zbraní: výzvy a budoucnost“ se zabývá problematikou nešíření jaderných zbraní, konkrétně pak aktuálními obtížemi nonproliferačního režimu a jeho budoucím směřováním. V úvodní části je analyzován vznik a vývoj režimu, zejména pak jeho dvou základních konstitučních prvků, které představuje Mezinárodní agentura pro atomovou energii (MAAE) a její zárukový systém a Smlouva o nešíření jaderných zbraní (NPT). Možnosti praktické aplikace nástrojů nonproliferačního režimu jsou ilustrovány na aktuálním případu íránského jaderného programu, na němž jsou dokladovány limity systému. Stěžejní část disertační práce je věnována hlavním obtížím nonproliferačního systému, a to jak aktuálním, tak těm, jejichž význam by se měl teprve ukázat. Identifikovanými problémovými oblastmi je zejména rozvoj technologií dvojího použití a přenos technologií, jaderná „renesance“ a její důsledky pro nonproliferační režim, vztahy se státy stojícími mimo NPT (tj. s Indií, Pákistánem, Izraelem a Severní Koreou), dynamika bezpečnostního prostředí a to jak ve smyslu dalšího vývoje rizikových regionů, tak ve smyslu nástupu relativně nových fenoménů, jako jsou nestátní aktéři a jejich zájem o jaderné zbraně. Poslední stěžejní výzvu nonproliferačního režimu představuje politika jaderného odzbrojování zejména ve své maximalistické variantě světa bez jaderných zbraní. Jako nejpalčivější obtíž je pravděpodobně možné označit vztahy vůči státům stojícím mimo režim, které mohou jeho fungování z několika důvodů oslabit. Dále je v práci zmíněna nutnost posílení role dodatkového protokolu, bez jehož univerzálnější implementace budou i nadále možnosti MAAE v oblasti záruk velmi omezené (jak dokumentuje i případ Íránu). Očekávat v současnosti přistoupení ke smlouvě NPT od států stojících mimo ni je nerealistické, což je pro některé její signatáře obtížně akceptovatená myšlenka. Režim jako celek by však s jejich postavením měl pracovat lépe a měl by se pokoušet o konstruktivnější dialog. V opačném případě budou výsledky jednání jeho institucí přinášet stále větší rozčarování jak jeho členům, tak státům, které stojí mimo něj. Režim by tím v budoucnu mohl ztrácet na relevantnosti.

Abstract:

The dissertation thesis „Nuclear Weapons Nonproliferation Regime: Challenges and Future“ deals with the topic of nuclear weapons nonproliferation, specifically with current issues of the nonproliferation regime and with factors that could affect its future development. The opening part of the thesis analyzes an emergence and an early development of the regime, more precisely of the two constitutional elements – International Atomic Energy Agency (IAEA) and her safeguard system and the Non-proliferation Treaty (NPT). Practical applications of the nonproliferation instruments are illustrated by the case study of Iranian nuclear program, which clearly shows the limits of the system. The core part of the thesis is dedicated to the main issues of the nonproliferation regime – both to the current ones, as well as to the ones that could reveal its importance in the future. The main identified challenges of the regime are: development of dual-use technologies and their transfers, nuclear „renaissance“ and its consequences for the nonproliferation, relations with countries that stays outside the regime (i.e. India, Pakistan, Israel and North Korea), dynamics of security environment, including security development of regions of risks and emergence of relatively new phenomenon like interest of non-state actors in nuclear weapons. The last crucial challenge is the policy of nuclear disarmament, especially its most extreme variant that seeks nuclear weapons free world. As the most pressing issue were identified the relations with countries outside the regime, that has potential to weaken the regime for several reasons. The thesis also mentions the importance of further strengthening of Additional Protocol. Without its more universal implementation, the capabilities of IAEA will be limited (as the Iranian case study suggests). It would be unrealistic to expect that the non-party countries will join the NPT, although for some members of the regime this idea is difficult to be accepted. Nevertheless the regime as whole should cooperate in a more constructive way with these countries. Otherwise the results of contacts with India, Pakistan etc. will bring about more and more frustration both to the regime members and to the nonmembers alike.
