The contracting process in supplier relationships in current legislation

Abstract:

Diplomová práce je zaměřena na kontraktační proces ve vztazích mezi podnikateli s orientací na současnou právní úpravu, kromě současné legislativy je však obsahem i nastíněni historického vývoje kontraktační problematiky na našem území, a to v první kapitole. Proces uzavírání smluv je v práci analyzován z několika základních hledisek, orientace je směřována na model nabídky a jejího přijetí, předsmluvní odpovědnost, možnosti úprav smluvních ujednání a dále účinky smlouvy včetně právních následků v případě jejího porušení a zvláštní způsoby kontraktačního procesu. V obsahu práce jsou uvedeny poznatky a pozměňovací návrhy včetně komparace dané problematiky s předchozí úpravou. V závěrečné kapitole se dále nachází výsledky dotazníkového šetření s vyhodnocením způsobu kontraktace současných podnikatelů a jejich úrovně orientace v této problematice.

Abstract:

The diploma thesis is focused on the concracting proces in supplier relationships in current legislation, but in addition to the current legislation is also outlined the historical development of contracting process in our territory, in the first chapter. The process of concluding contracts is analyzed on several basic points of view, focusing on the model of the offer and the acceptance, pre-contractual liability, the possibility of adjusting contractual arrangements and the effects of the contract, including legal consequences in case of breach and special ways of contracting process. The thesis includes findings and amendments and a comparison of process of concluding contracts with the previous legislation.. The final chapter also contains the results of the questionnaire survey with the evaluation of the method, how current businessmans conclude the contracts and their level of the orientation in this.
