Abstract:

Bakalářská práce na téma „Vyživovací povinnosti a důsledky jejich neplnění“ se zaměřuje na jednotlivé druhy vyživovacích povinností a na důsledky, ke kterým dochází v případě jejich neplnění. Cílem práce, kterého chci dosáhnout, je analyzovat vyživovací povinnosti a důsledky jejich neplnění tak, abych je dostatečně vysvětlila a také srovnala s novou právní úpravou,která vstoupí v účinnost s počátkem roku 2014. V první části popisuji zákonnou úpravu, jak probíhá soudní řízení, a samozřejmě jednotlivé druhy vyživovacích povinností a rozdíly mezi nimi. Druhá částse týká již zmiňovaných důsledků, a to jak občanskoprávních, tak trestněprávních. Třetí konečná část je srovnání mezi aktuálně účinným Zákonem o rodině a novým občanským zákoníkem. Výsledkem práce by tak měl být ucelený pohled na problematiku vyživovací povinnosti, který poskytne jak přehled zákonné úpravy, tak její praktické dopady, a to jak z pohledu osob, které mají na výživné nárok, tak i z pohledu osob, které tyto povinnosti mají plnit, avšak v mnohých případech tak nečiní.

Abstract:

The bachelor’s dissertation on the topic „Maintenance obligations and the consequences of their failure“ focuses on the different types of maintenance obligations and the consequences that stem from not fulfilling their requirements. My aim in this dissertation, was to analyse the aliment requirements and the consequences of failure to fulfill them, so that they are fully explaied and to compare it to the legitimate, which will take effect at the beginning of 2014. In the first part, I describe the legal regulation, how judicia proceeding runs and of course the individual forms of ailment requirements and their differences. The second part concerns the afformentioned consequences, both civil and criminal. The third and last part is about the current Family Code and the new Civil Code. The result of my dissertation should be an overall concise summary of the aliment problematic, which will provide a overview of legal regulation, its practical implications from the perspective of those who have the rights to it, as well as from the perspective of those required to fulfill it, but in many instances do not.
