Abstract:

Sexting je aktuálním společenským fenoménem, na nějž je třeba najít adekvátní odpověď. Ač v médiích je oblíbeným tématem, pozornosti odborné právní veřejnosti zatím uniká. Trend sextingu je rozšířen zejména mezi teenagery, kteří si často plně neuvědomují rizika, včetně závažných trestněprávních sankcí, kterou s sebou takovéto chování potencionálně nese. Tato práce definuje pojem sextingu mezi dětmi a mladistvými v jeho společenském a právním kontextu a identifikuje možné způsoby řešení, a to zejména na základě analýzy dostupných doktrinálních a judikatorních přístupů ve Spojených státech amerických. Dále rozebírá ústavněprávní aspekty sexting, zejména aspekt svobody slova, práv rodičů a práva na soukromí a sexuální intimitu. Primárním cílem tedy je seznámit čtenáře s právními aspekty problematiky sextingu a vytvořit tak pozadí k diskuzi i v podmínkách České republiky.

Abstract:

Sexting is a recent social phenomenon on which law and society is trying to find a proper answer. Despite being widely featured in mass media the phenomenon of sexting has been quite ignored by legal scholars yet. Sexting trend is spread mainly among teenagers who are not often fully aware of all the potential risks, including severe criminal penalties, connected with such behavior. This thesis defines the term of sexting between teenagers in its social and legal context as well as identifies the possible solutions based mainly on analysis of available doctrinal and courts approach in United States. Moreover, this thesis will analyze constitutional aspects of sexting, especially the possible violation of freedom of speech, parental rights and private sexual intimacy rights. The key aim of this thesis is to introduce the sexting issue and its legal aspects to the readers and create the background for the discussion also in the Czech Republic.
