Lease Agreement

Abstract:

Diplomová práce se zabývá leasingem, především pak právní úpravou leasingové smlouvy. První část práce pojednává o historii leasingu, vymezení samotného pojmu "leasing", rozdělení leasingových operací podle různých kritérií, průběhu leasingové transakce a českém leasingovém trhu a subjektech na něm působících. Druhá část je zaměřena na právní úpravu leasingové smlouvy v českém, evropském i mezinárodním právu. Třetí část porovnává úpravu všeobecných obchodních podmínek leasingu vybraných společností poskytujících leasingové služby se vzorovými podmínkami vytvořenými a doporučenými Českou finanční a leasingovou asociací. Závěrečná část popisuje výhody leasingu jako formy financování.

Abstract:

This thesis, "Lease agreement", deals with the topic of lease, especially with the legal aspects of a lease agreement. The first part addresses the history of a lease, the definition of the term "lease", the classification of lease operations according various criteria and the process of a lease transaction and the Czech lease market and its subjects. The second part is focused on the legal aspects of lease contract in terms of Czech, european and international law systems. The third part's aim is to compare the general terms and conditions of selected lease companies performing on the Czech market with general terms and conditions recommended by Czech Lease and Finance Association. The final part of this thesis intorduces advantages of lease as a form of funding.
