Right to Life vs. Right to Self-Determination (Abortion Cases in Comparative Perspective)
Abstract:
Diplomová práce se zabývá ústavněprávními (resp. lidsko-právními) základy a trestněprávními aspekty problematiky umělého přerušení těhotenství. Zaměřuje se především na přístupy jednotlivých vybraných států (USA, Německo, Kanada, Kolumbie a ČR) k právu na život zárodku a k právu na sebeurčení ženy a na vývoj trestněprávní úpravy interrupcí a související judikatury ústavních soudů v těchto státech.
Abstract:
The diploma paper deals with the constitutional (human rights) basis and criminal aspects of the issue of abortion. The paper focuses foremost on the attitudes of selected states (United States, Germany, Canada, Colombia and Czech Republic) toward the right to life of the foetus and the right to self-determination of the woman and on the development of the regulation of abortion under criminal law …more
