Abstract:

Diplomová práce se zabývá aktuální problematikou dětských exekucí. Je rozdělena do 8 kapitol, které se jim věnují nejprve z právního ukotvení nezletilých a poté především z procesního hlediska. Zaměřuje se na pojetí odpovědnosti nezletilých za dluhy, jejich důvody vzniku a následné řešení. Práce je pojata jako analýza současné právní úpravy, přičemž se především zaměřuje na pojetí odpovědnosti nezletilých za dluhy, jejich nejčastější důvody vzniku a postavení zákonných zástupců v celém procesu. Rovněž se věnuje rozsáhlé judikatuře soudů s ohledem na danou problematiku a její náročnou praxi.

Abstract:

The diploma thesis deals with the current issue of child executions. It is divided into 8 chapters, which are devoted to them first from the legal anchoring of minors and then mainly from the procedural point of view. It focuses on the concept of minors' responsibility for debts, their causes and subsequent solutions. The work is conceived as an analysis of the current legislation, while it primarily focuses on the concept of the responsibility of minors for debts, their most common reasons for their origin and the position of legal representatives in the entire process. It also deals with the extensive jurisprudence of the courts with regard to the given issue and its demanding practice.
