Consumer Protection in Czech Law

Abstract:

Cílem této práce je podat obecný přehled o platné právní úpravě ochrany spotřebitele v českém právu a analýza a zhodnocení úrovně veřejnoprávní ochrany spotřebitele v oblasti práv při uplatnění a vyřízení reklamace v našem státě, posouzení jejího rozsahu, kvality a možností dozoru a na základě toho i navrhnout, jakým směrem by se v ČR mohly ubírat možné změny právní úpravy v této oblasti. Vyjma úvodu a závěru se práce člení na pět částí. První část se zabývá historickým vývojem ochrany spotřebitele v českých zemích a vysvětluje základní pojmy této oblasti. Druhá část práce seznamuje s hlavními právními předpisy, o které se u nás ochrana spotřebitele opírá. S ohledem na rozsáhlost problematiky ochrany spotřebitele a zvážení významnosti jejích oblastí se práce ve třetí části blíže zaměřila již jen na právní úpravu oblasti reklamací, aby zanalyzovala její rozsah a dostatečnost, podrobně pak na příslušnou část zákona o ochraně spotřebitele. Ve čtvrté části byla zařazena vybraná judikatura, která měla význam pro dané téma a pomohla ozřejmit i nejednoznačnost výkladu některých částí veřejnoprávní úpravy. Pátá část se zabývala hodnocením úrovně veřejnoprávní ochrany spotřebitele v oblasti práv při uplatnění a vyřízení reklamace v porovnání s právní úpravou existující na Slovensku.

Abstract:

The aim of this work is to give a general overview of the valid legal regulation of consumer protection in Czech law and analyse and evaluate the level of public protection of the consumer in the field of rights in the application and processing of a complaint in our state, an assessment of its scope, quality and possibilities of supervision and, on the basis of this, to suggest what direction the Czech Republic could take possible amendments to the legislation in this area. Except for the introduction and conclusion of the work on five parts. The First part deals with the historical development of consumer protection in the Czech countries and explains the basic concepts of this area. The Second part of the thesis introduces the main regulations, which are based on our protection of consumers. In view of the breadth of the protection of the consumer and the importance of its areas, the work in the third part approached it only on the legal regulation of the complaint area, to analyse its scope and sufficiency, in detail on the part of the Law on Protection of consumers. In the fourth part, selected case law was included, which was relevant to the topic and helped to explain and ununequivocality the interpretation of some parts of the public regulation. The Fifth part dealt with the evaluation of the level of public protection of the consumer in the field of rights when claiming and handling the claim in comparison with the legislation existing in Slovakia.
