Abstract:

Závěrečná práce se zabývá problematikou dokazování ve správním řízení. Je zaměřena na otázku práv účastníka řízení v případech, kdy je dokazování prováděno mimo ústní jednání. V úvodu závěrečné práce je stručně zmíněna problematika, cíle práce a použité metody. V teoretické části jsou představeny základní pojmy a teorie týkající se dokazování ve správním řízení. Praktická část je věnována dokazování, když jejím hlavním cílem je problematika práv účastníka řízení při dokazování mimo ústní jednání, způsobu provedení důkazu listinou a dále vadám v řízení a jejich vliv na zákonnost správního rozhodnutí. Závěr práce je rekapitulací poznatků prezentovaných v bakalářské práci. V závěrečné práci je využita metoda analytická a výkladová. Při práci s rozhodnutími Nejvyššího správního soudu je použita metoda srovnávací.

Abstract:

This bachelor´s thesis is concerned with issues pertaining to the gathering and presentation of evidence in administrative proceedings, focusing on the participants’ rights in the proceedings if and when the evidence procedure occurs outside the framework of verbal discourse. The introductory part sums up the topic, the objectives of the thesis and methods applied. The theoretical part presents the basic concepts and theories concerning the evidence procedure in administrative proceedings. The practical part is concerned with the gathering and presentation of evidence, focusing on the rights of parties to the proceedings when the evidence procedure occurs outside the framework of verbal discourse, with ways of presenting documentary evidence, and with defective proceedings and their impact on the legality of an administrative decision. The final part recapitulates all findings presented in the thesis, with analytic and interpretative methods used. When tackling the decisions of the Supreme Administrative Court, the comparative method is used.
