Tax obligations of entrepreneurs in the field of gastronomy services

Abstract:

Cílem této bakalářské práce je zachytit daňové povinnosti podnikatelů v oblasti gastronomických služeb. Jedná se o zobrazení především těch daňových povinností, které nejvíce ovlivňují jejich činnost. K dosažení tohoto cíle byla využita metoda analýzy a následně metoda dedukce. První část této práce je zaměřena teoreticky. Jsou zde uvedeny právní formy provozování podniku v rámci legislativy České republiky, ucelený pohled na daňový systém, definice jednotlivých daní včetně elektronické evidence tržeb a možnosti daňové optimalizace. Druhá část, praktická, je zaměřena na rozbor konkrétních daňových povinností podnikatele v gastronomických službách. Úvod obsahuje obecné informace o podnikateli, podmínky vedení a zpracovávání podkladů a následně je v této části analýza jednotlivých daní a zobrazení jejich vlivu na podnikatele. Tyto výstupy jsou následně zhodnoceny. Třetí částí je část návrhová. Zde jsou uvedeny návrhy daňové optimalizace jednotlivých daňových povinností, které působí na tohoto podnikatele. Pro širší pojetí jsou vytvořeny i modelové situace. Tato část se zabývá také specifickými nedostatky a návrhy na jejich opravu. V závěru práce jsou shrnuty dosažené výstupy a je zde vytvořen ucelený pohled na problematiku. Zároveň jsou zde uvedeny odpovědi na výzkumné otázky.

Abstract:

Goal of this bachelor thesis is to describe tax liabilities of entrepreneurs in field of gastronomic services. The description is focused on those tax liabilities, which can interfere with activities of such entrepreneurs. In pursuit of this goal, the methods of analysis and deduction are used. First part of this thesis is focused on theory. This chapter is describing (dis)advantages of individuals (such as sole trader) and legal entities (such as limited liability company) under the law of Czech Republic. This part is followed by comprehensive description of the tax system regarding entrepreneurs in field of gastronomic services, the definition of taxes individually, including technical obligations – EET and tax optimization options. Second part is dealing with practical utilisation of the first part. Analysis of specific tax obligations of the entrepreneur in gastronomic services ensues. The introduction contains general information about entrepreneur, conditions of management and processing of documents. This part also contains the analysis of individual taxes and their impact on entrepreneur in field of gastronomic services. These outputs are subsequently evaluated. The third part presents proposals for tax optimization of individual tax obligations. For a broader concept, model situations are also created. This section will also address specific shortcomings and suggestions for suitable corrections. At the end of the thesis are summarized the achieved outputs and created a comprehensive view of the problem. At the same time, answers to research questions are hereby provided.
