Tariffs of the collective management organisations

Abstract:

Diplomová práce analyzuje, ve světle teoretických východisek dané problematiky rozebraných v její první polovině, sazby odměn vybíraných kolektivními správci a naplňování požadavku na jejich přiměřenost a nediskriminační přístup vůči uživatelům předmětů ochrany ze strany kolektivních správců, jak je upraveno evropským právem, jež je pramenem pro národní právní úpravu. Práce obsahuje také popis sjednávání sazebníků kolektivních správců, který je v příloze práce graficky znázorněn, a také s tématem související otázku řešení sporů mezi jednotlivými subjekty. V poslední části diplomové práce je problematika shrnuta a prostřednictvím úvah de lege ferenda je navrhnuto řešení některých, prací analyzovaných, problematických aspektů výkonu kolektivní správy.

Abstract:

The diploma thesis analyzes, in the light of the theoretical bases of the problematics, discussed in its first half, the rates of remuneration collected by the collective management organizations and the fulfillment of the requirement of its adequacy and their non-discriminatory approach to the users of protected subject matter, as regulated by the European legislation (as the source of national legislation). The thesis also contains a description of the negotiation of collective management organizations' tariffs, which is illustrated graphically in the appendix of the thesis, as well as the related issue of solving disputes between individual entities. In the last part of the diploma thesis, the issue is summarized and through de lege ferenda considerations it proposes to solve some, in the thesis analyzed, problematic aspects of the collective administration.
