Comparison of securing liabilities legislation of the Czech Republic and Russian Federation

Abstract:

Diplomová práce je zaměřena na porovnání ruské a české právní úpravy veškerých zajišťovacích institutů v rámci občanského práva. První kapitola obsahuje stručný přehled o způsobech, jakými je zajištění závazků upraveno v České republice a v Ruské Federaci. Druhá kapitola se věnuje obecné úpravě zajištění závazků a vymezuje veškeré zajišťovací instituty. Poslední kapitola obsahuje problematiku způsobů zániku závazků. Struktura práce je postavena tak, že se každá podkapitola nejdřív podrobně věnuje právní úpravě České republiky v bodě A. V bodě B se zaměřuje na rozbor právní úpravy Ruské Federace především z hlediska shledání nejzásadnějších rozdílů oproti české právní úpravě. V závěru jsou shrnuty nejvýznamnější rozdíly právních úprav obou zemí a vyhodnocení stanovených hypotéz.

Abstract:

The diploma thesis is focused on the comparison of the securities legislation of the Czech Republic and Russian Federation under the civil law. The chapter 1 of thesis defines basic concept of the way how securing liabilities are regulated by the law of Czech Republic and Russian Federation. The chapter 2 focuses on the general regulation of the securing liabilities and defines all the securities. The last chapter specifies the issues about the ways of extinguishing obligations. Every sub-chapter is devoted to analysis of legislation of Czech Republic in a paragraph A. Paragraph B focuses on the analysis of legislation of Russian Federation from the position of meeting the most fundamental differences in comparison with legislation of Czech Republic. In the conclusion there is a summary of the most significant differences between the legislation of both countries and the evaluation of the established hypotheses.
