Cryptocurrencies: The European Union’s Golden Opportunity or a Regulatory Nightmare?

Anotácia:

Diplomová práce se zabývá kryptoměnami ve světle současných a připravovaných regulací v Evropské unii. Zamýšlí se nad vybranými národními i evropskými regulačními strategiemi. Velká pozornost je věnována konkrétnímu tématu, kde se zájem o decentralizaci kryptoměn střetává s nutností regulace za účelem ochrany spotřebitelů. Konečně se tato soustředí na problém nazývaný „issuer dilemma“. Zatímco současný regulační režim byl shledán neuspokojivým, zdá se, že ze strany evropských orgánů je o problematiku velký zájem, což se odráží v nejmodernějším návrhu regulace MiCA. Ovšem ani nařízení MiCA není schopno ošetřit issuer dilemma v plném rozsahu a je třeba se nad tímto problémem dále zamýšlet. Aby by byl tento problém vyřešen pro bezpečnost všech spotřebitelů, jelikož kryptoměny představují velký potenciál, ale nejsou bez rizika.

Abstract:

The thesis contemplates cryptocurrencies in light of current and upcoming regulations in the European Union. It ponders over both selected national as well as European frameworks. Much scrutiny is given to a particular topic where the interest of keeping cryptocurrencies decentralized clashes with the necessity to regulate to protect the consumers. Ultimately the thesis calls this conundrum the 'issuer dilemma.' While the current regulatory regime was deemed unsatisfactory, there seems to be plenty of interest from the European authorities, which is reflected in the state-of-the-art MiCA regulation proposal. That said, even the MiCA regulation is not able to circumvent the issuer dilemma in its entirety, and more thought has to be given to this problem should it be resolved for the betterment of the European people, as cryptocurrencies showcase much potential but are not without their risks.
