Some Problems of Accountability of an Armed Attack
Abstract:
Práce se zabývá vymezením pojmů ozbrojený útok a útočný čin jako kategorií, které užívá ius ad bellum. Zvláštní důraz je kladen na vymezení pojmu ozbrojený útok, který je hlavním kritériem pro vzniku práva na sebeobranu. Ozbrojený útok je dále zkoumán z hlediska jeho přičitatelnost, jež je klíčovou podmínkou pro plné uplatnění práva na sebeobranu.
Abstract:
This thesis is analyzing terms armed attack and act of aggression which are main categories of ius ad bellum. The core of this thesis is focused on describing armed attack – the only circumstance on which the right of self-defence may be successfully invoked. Accountability of armed attack is analyzed for being the key condition for using force in self defence against states.
