The principle of subsidiaryty of criminal repression and the ensuing principle of criminal law "ultima ratio" in Czech criminal law

Abstract:

Rigorózní práce se zabývá zásadou subsidiarity trestní represe a z ní vyplývajícím principem trestního práva jako prostředku ultima ratio v českém trestním právu. Popisuje jejich historický vývoj v českém trestním právu až po aktuální legislativní zakotvení v trestním zákoníku (§ 12 odst. 2 TZ). Zevrubně rozebírá problematické aspekty intepretace a aplikace daného institutu, ale též nejednotnost právní teorie a rozhodovací soudní praxe (včetně rozhodovací praxe Nejvyššího soudu ČR a Ústavního soudu ČR), kterou se pokusily odstranit sjednocující a výkladová stanoviska k § 12 odst. 2 TZ vydaná po nabytí účinnosti TZ. V kapitole čtvrté je česká právní úprava srovnávána se zahraniční právní úpravou. Současně je v závěru práce věnován prostor pro vlastní hodnocení a zjištění ze strany autora, a vyjádření jeho návrhů de lege ferenda, které vyplývají ze zjištění učiněných k zásadě subsidiarity trestní represe a z ní vyplývajícího principu trestního práva jako prostředku ultima ratio v českém trestním právu.

Abstract:

The topic of the thesis deals with the principle of subsidiarity of criminal repression and the resulting principle of criminal law as a means of ultima ratio in Czech criminal law. It describes their historical development in Czech criminal law up to the current legislative anchoring in the Criminal Code (of the Section 12 par. (2)). It thoroughly discusses problematic aspects of the interpretation and application of the institute, but also the inconsistency of legal theory and decision-making judicial practice (including the decision-making practice of the Supreme Court of the Czech Republic and the Constitutional Court of the Czech Republic), which was tried to remove by the unifying and interpretative opinions of the Section 12 par. (2) in the Criminal Code. In Chapter Four, the Czech legislation is compared with foreign legislation. At the same time, the conclusion of the thesis devotes space to the author's own evaluation and findings, and to the expression of his proposals de lege ferenda, which result from the findings made on the principle of subsidiarity of criminal repression and the resulting principle of criminal law as a means of ultima ratio in Czech criminal law.
