Abstract:

Bakalářská práce se zabývá problematikou daňových a celních trestných činů podle platných právních předpisů. Cílem závěrečné práce je definovat a analyzovat vybrané trestné činy a zároveň jejich trestněprávní postih. Dále by měla čtenáře seznámit s obecnými základy, ze kterých daňové a celní trestné činy vycházejí. Ve stručnosti přiblížím hospodářskou kriminalitu z pohledu kriminologického a nastíním vývoj daňových trestných činů od roku 1835 do roku 1989. Ve čtvrté kapitole rozebírám skutkové podstaty jednotlivých trestných činů, především se zaměřením na nejvíce páchané hospodářské trestné činy, ke kterým v České republice zpravidla dochází. Následně se zabývám analýzou zahraniční právní úpravy s provedením krátké komparace. Závěrečná část práce pojednává o Celní správě České republiky, jakožto o organizační složce státu, jejímž cílem je chránit bezpečnostní a ekonomické zájmy občanů ČR. Rovněž jsem si dovolil uvést současné snahy zákonodárců o legislativní změny týkající se rozšíření pravomocí celní správy.

Abstract:

The bachelor thesis deals with the issue of tax and customs crimes according to the valid legal regulations. The aim of the final work is to define and analyze the selected crimes and thein criminal penalties. Furthermore, revers should familiarize themselves with the general foundations of tax and customs offenses. I briefly outline economic kriminality from a criminological point of view and outline the development of tax offenses from 1835 to 1989. In the fourth chapter I analyze the facts of individual crimes, especially with the focus on the most crimes committed in the Czech Republic as a rule. Then I analyze the foreign legal regulation with a short comparison. The final part of the thesis deals with the Customs Administration of the Czech Republic, as an organizational component of the state, whose aim is to protect the security and economic interests of the Citizen of the Czech Republic. I also allowed mysem to mention the current efforts of legislators to bring about legislative ganges concerning the extensit of customs administration powers.
