Patients Right to Choose Its Health Care Provider

Abstract:

Diplomová práce za zabývá právem pacienta na volbu poskytovatele zdravotních služeb. Pacienti mají v České republice možnost volby poskytovatele již od začátku devadesátých let minulého století, ale práva poskytovatelů a pacientů se od té doby značně změnila. Vývojem prošlo i právo pacienta na volbu poskytovatele zdravotních služeb. Práce se zaměřuje na právní vztah mezi pacientem a poskytovatelem zdravotních služeb, krátce se věnuje povaze tohoto vztahu a následně i prozkoumává, kdo je k volbě poskytovatele oprávněn. Hlavní zaměření práce ovšem spočívá ve zhodnocení omezení pacientova práva na volbu poskytovatel zdravotních služeb. Pokud se máme blíže věnovat právu pacienta na výběr poskytovatele, jsou zde některé otázky, které by měly být zodpovězeny, např. náleží toto právo i nezletilým? Či mohou příbuzní pacienta v bezvědomí vybrat poskytovatele za něj? Po krátké diskuzi o možných řešeních jsou navrženy odpovědi na tyto otázky. Nicméně, hlavní náplň práce se věnuje jednotlivým omezením a překážkám, se kterými se pacienti setkávají, musí vypořádat, pokud se rozhodnou zvolit si poskytovatele zdravotních služeb. Hlavní myšlenkou této práce je prozkoumat omezení pacientů při volbě poskytovatele zdravotních služeb a posoudit jejich vhodnost a nezbytnost. Právo pacientů vybrat si svého poskytovatele zdravotní péče končí tam, kde začíná právo poskytovatele odmítnout pacienta. Zákon 372/2011 Sb., o zdravotních službách, dává poskytovateli možnost odmítnout pacienta a právo ukončit poskytování zdravotní péče pacientovi. Nicméně, tyto možnosti jsou přísně omezeny a regulovány, v zájmu zachování přístupu ke zdravotní péči pro pacienty. Na druhou stranu, některé z těchto možností daných zákonem, které dávají poskytovateli právo odmítnout pacienta, není snadné odůvodnit, neboť jsou příliš vágní. To může vést k situaci, kdy poskytovatelé mohou zneužít těchto ustanovení. Navíc, v reálném životě se pacienti setkávají s dalšími překážkami při výběru svého poskytovatele zdravotní péče, např. s protiprávními registračními poplatky. Pacienty v dnešní době zajímá i možnost poskytování zdravotních služeb v jiném členském státě; proto se práce se zabývá otázkou, zda je možné si vybrat poskytovatele zdravotních služeb v jiném členském státě. Proto práce zkoumá jednotlivé typy zdravotní péče poskytované na základě nařízení č. 883/2004 a směrnice o uplatňování práv pacientů v přeshraniční zdravotní péči. Navíc je krátce prozkoumána i judikatura Soudního dvora Evropské unie, a to s ohledem na právo pacientů vybrat si svého poskytovatele zdravotních služeb. V návaznosti na směrnici je prozkoumán také přínos novely právních předpisů regulující poskytování přeshraničních zdravotních služeb. V poslední kapitole je pozornost věnována vzácné ale celkově závažné situaci. Pacient si zvolí poskytovatele zdravotních služeb, který ale překročil finanční limit pro poskytovanou zdravotní péči. Tento poskytovatel, na základě právní úpravy z roku 2013, stál před otázkou, zda si vybrat mezi poskytováním zdravotní péče s jistotou velmi omezeného příjmu (vyplácena by mu byla pouze pro jednu třetinu z ceny poskytnuté zdravotní péče), nebo zda neposkytovat zdravotní služby vůbec. Když vezmeme v úvahu, že pacienti, neměl jinou možnost, než hledat jiného poskytovatele, je jasné, že jejich právo na výběr poskytovatele zdravotní péče bylo ovlivněno. Pro přiblížení tématu jsou v práci uvedeny ukázky dotazů z poradny Férová nemocnice, právní poradenské služby zaměřené na práva pacientů a zdravotnické právo, která poskytuje on-line poradenství pro pacienty a lékaře.

Abstract:

The thesis is dealing with patient’s right to choose its health care provider in the health care system provided by public health insurance. Patients in the Czech Republic have had the right to choose their health care provider since the beginning of the 1990’s; however their rights and duties and rights and duties of health care providers have undergone some progress. And the patient’s right to choose its health care provider has evolved as well. The thesis is focused on the legal aspects of the patient and health care provider relationship, briefly examining its nature and looking in greater depth on who is entitled to choose its health care provider. In addition to that, there are some questions that need to be answered when we examine this patient’s right, e.g. whether minors are able to exercise this right on their own or whether the relatives of an unconscious patient should be enabled to choose the provider for the patient. After short discussion about the possible solutions, the answers for these questions are given finally. However the main focus of the thesis lays on the limitations and obstacles, which patients encounter and have to deal with when they choose health care providers, with regard to the choice of a registering physician, e.g. a general practitioner. Altogether, the main idea of this thesis is to examine the limitations of the right to choose a health care providers and assess their appropriateness and necessity. The patient’s right to choose its health care provider ends where the right of the provider to refuse the patient starts. Quite equitably, the law gives the provider the possibility to refuse the patient and the right to cease providing health care to the patient under special circumstances. However, these options are strictly limited and regulated, for the sake of preserving the access to health care for patients. On the other hand, some of the provisions given by the Act. No. 372/2011 Coll., giving the right to refuse a patient, lack reasoning or are too vague. This can lead to a situation where physicians misuse these provisions. Moreover, in the real life, patients encounter other obstacles while choosing their health care provider, e.g. unlawful registration fees. Having in mind that patients nowadays do not only profit from health care provided in their member state, the thesis deals with the question if it is possible to choose a health care provider in another member state. To examine this area, the types of health care provided under Regulation No. 883/2004 and Directive on the application of patients’ rights in cross-border healthcare are inspected. Furthermore, the case law of the Court of Justice of the European Union is being examined with relation to the right of patients to choose their health care provider. Also, the Directive on the application of patients’ rights in cross-border healthcare is examined. In connection to the Directive, the outcomes of the new legislation in progress are being looked at. In the last chapter, the attention is given to a rare, however grave, situation. A patient chooses a health care provider, which has exceeded its financial limit for health care services. This provider, under the 2013 rules, could choose between providing health care with a worrying thought of very limited income (being paid only for one third of the price of the health care provided) or not providing health care at all. When we take into consideration that patients had no choice but to look for another provider, it is clear that their right to choose health care provider was affected. In addition to that, the thesis is illustrated by enquiries from Férová nemocnice/Fair Hospital, a legal counselling service, focused on health law and rights of patients, providing on-line legal and human rights consultancy for different patients and physician problems.
