Legal regulation of advertising from the perspective of protecting children and youth

Abstract:

Diplomová práce je zaměřena na problematiku právní regulace reklamy v ČR z pohledu ochrany dětí a mládeže. Cílem práce je analýza platné právní regulace reklamy v ČR ve vztahu k dítěti jako spotřebiteli, zhodnocení právní i mimoprávní regulace reklamy a formulace konkrétních doporučení zadavatelům a zpracovatelům reklam.Hlavní metodou práce je analýza relevantních případů rozhodovací praxe v kontextu evropské a vnitrostátní právní regulace.Analýza ústí v souhrn zjištění, dle kterých je právní regulace reklamy v zásadě komplexní a dostačující za předpokladu paralelního fungování samoregulace reklamy. Jako problematický práce naopak hodnotí dozor nad dodržováním právních předpisů a informovanost veřejnosti o možnostech vznášení stížností u příslušných státních orgánů a samoregulačních orgánů.

Abstract:

This thesis focuses on the problem of the legal regulation of advertising in the Czech Republic from the perspective of protecting the children and youth. The aim of the thesis is to analyze the current legal regulation of advertising in the Czech Republic in relation to the child consumer, to evaluate the legal and extralegal regulations that are in place, and to formulate concrete recommendations for advertisers and advertisement creators. The main methodology of the thesis is the analysis of relevant cases of the decision making practice in the context of european and national legal regulations. The analysis translates into a set of findings, according to which the level of legal regulation of advertising is complex and sufficient under the assumption of a parallel self regulation of advertising. On the other hand, the thesis evaluates the supervision over the compliance with the legislation and the public awareness of the possibilities to raise complaints with the competent national authorities and self regulating institutions as problematic.
