Legal Problems of EU Asylum Policy

Abstract:

Tato diplomová práce představuje azyl jako institut mezinárodního práva a zabývá se především azylovým právem Evropské unie. Popisuje jeho strukturu a vývoj, přičemž reflektuje také přijetí nových směrnic a nařízení a kriticky je hodnotí. Práce se také věnuje aktuálním jevům v oblasti azylového práva, které jsou ovlivňovány azylovým systémem EU. Cílem práce je najít a poukázat na nedostatky azylového práva Evropské unie. Práce konkrétně zkoumá, zda azylový systém EU funguje v souladu s Úmluvou o ochraně lidských práv a základních svobod, přičemž odkazuje na judikaturu Evropského soudu pro lidská práva.

Abstract:

This thesis introduces asylum as an institute of the international law and it engages chiefly in the asylum law of the European Union. It describes its structure and development while it also reflects adoption of new directives and regulations which are critically evaluated in the thesis. The thesis also deals with current phenomena in the field of asylum law which are affected by the asylum system of the EU. The aim of this thesis is to find and point out the deficiencies of EU asylum law. The thesis specifically examines whether the asylum system of the EU works in accordance with the Convention on Human Rights and it refers to the case law of the European Court of Human Rights.
