Intangible assets in business

Abstract:

Cílem této bakalářské práce je přiblížit čtenáři institut nehmotných statků neboli duševního vlastnictví v podnikatelském prostředí. Nejdříve je v práci přiblížena problematika z historického hlediska. Dále je popsáno, o jaký právní rámec se problematika opírá a to, jak na základě platné právní úpravy ČR, tak v rámci právní legislativy Evropské unie. V další části práce je popsáno, jakým způsobem je v ČR zajištěna ochrana majitelům duševního vlastnictví prostřednictvím státních složek a institucí. Dále se čtenář dozví, co je to tzv. užitný vzor, ochranná známka a průmyslový vzor a k čemu slouží. Praktická část je zaměřena na kontrolní činnost Celní správy ČR, která je jednou z hlavních státních složek státu určená pro boj s prodejci a výrobci padělaného zboží. Úkolem práce je provést analýzu dat z kontrolní činnosti celní správy v rámci odboru dohledu, který má mimo jiné za úkol odhalovat padělané zboží po celém území ČR. Z kvalitativní analýzy dat bylo zjištěno, který druh zboží je nejčastěji padělaným a odhaleným zbožím v rámci celé ČR a dále, které druhy padělaného zboží jsou nejčastěji zajištěny v rámci jednotlivých krajů potažmo krajských úřadů celní správy. Pro lepší představu jsou použity grafy, tabulky a obrázky ukazující vývoj zajištěného padělaného zboží v rámci uplynulých pěti let. Dále jsou vybráni tři zástupci vlastnící zapsané ochranné známky. Je zde popsáno, jaké ochranné prvky používají na svých výrobcích, aby znesnadnili možnost výrobek padělat či byly nápomocny k identifikaci padělku. V závěru této práce jsou na základě vlastního šetření a statistického rozboru interpretována zjištěná pochybení a uvedena vhodná doporučení.

Abstract:

The aim of this bachelor thesis is to introduce the institute of intangible assets or intellectual property in the business environment to the reader. First, the thesis presents the issue from a historical point of view. Furthermore, it is described, which legal framework the issue is based on, both on the basis of the current legislation of the Czech Republic and within the framework of the legal legislation of the European Union. The next part of the thesis describes how is the protection of intellectual property of the owners secured by state departments and institutions in the Czech Republic. Furthermore, the reader will learn what does a utility model, a trademark and an industrial design mean and what are they actually used for. The practical part of the thesis is focused on the control activities of the Customs Administration of the Czech Republic, which is one of the main state departments of the country designed to fight against sellers and manufactures of counterfeit goods. The task of the thesis is to analyse the control activities of the customs administration within the supervision department, which, among other things, has the task of detecting counterfeit goods throughout the territory of the Czech Republic. It was found from qualitative data analysis, which type of goods is the most frequently counterfeited and detected within the whole territory of the Czech Republic and which types of counterfeit goods are most often detected within individual regions, i.e. regional customs administration offices. For a better idea, graphs, tables and pictures showing the development of detected counterfeit goods over the past five years are used. In addition, three representatives owners of registered trademarks are selected. It is described in the thesis, what elements are used on their products to make it difficult to counterfeit the product. At the end of the thesis, the indentified errors are interpreted on the basis of their own investigation and statistical analysis and the appropriate recommendations are given.
