Qualification prerequisites for expert and appraiser activities

Abstract:

Diplomová práce se zabývá znaleckou činností a změnami, které přinesl nový zákon č. 254/2019 Sb. účinný od 1. ledna 2021 a zkoumá jeho dopady na znalce v České republice. Teoretická část práce vymezuje pojmy, shrnuje dostupnou literaturu k tématu a uvádí čtenáře do historie judikatury upravující znaleckou činnost. Nejdůležitější kapitolou teoretické části je popis výkonu znalecké činnosti, která poskytuje praktické informace z této profese. Poslední kapitola této části se zabývá kvalifikací uchazeče o zapsání do seznamu znalců. Praktická část analyzuje platný zákon, srovnává ho s jím nahrazeným zákonem č. 36/1967 Sb. o znalcích a tlumočnících a zaměřuje se na praktické změny, které znalci pocítili nejvíce. V závěru je na základě výzkumných metod potvrzena hypotéza, že přijetí tohoto zákona negativně ovlivnilo znaleckou činnost a výrazně přispělo k odchodu znalců z profese.

Abstract:

The diploma thesis deals with expert work and the changes brought about by the new Act No. 254/2019 Coll. valid as of 1/1/2021 and examines its effects on experts in the Czech Republic. The theoretical part of the work defines concepts, summarizes the available literature on the topic and introduces the reader to the history of jurisprudence regulating expert work. The most important chapter of the theoretical part is a description of the performance of expert work, which provides practical information from this profession. The last chapter of this part deals with the qualification of an applicant for registration in the list of experts. The practical part analyses the current law, compares it with the replaced one No. 36/1967 Coll. about experts and interpreters and focuses on the practical changes that experts felt the most. In the conclusion, based on research methods, the hypothesis is confirmed that the adoption of this law negatively affected expert activity and significantly contributed to the departure of experts from the profession.
