Supreme Audit Office - its Status and Field of Action

Abstract:

Jedním z nezbytných předpokladů fungování demokratického státu je existence efektivního a nezávislého kontrolního systému. V ČR tuto funkci plní Nejvyšší kontrolní úřad, jehož pozice je právně zaručena Ústavou. Tato instituce představuje nenahraditelný prvek parlamentní demokracie, neboť se jedná o orgán, který je zcela nezávislý na výkonné i zákonodárné moci. Tato bakalářská práce se zabývá historií Nejvyššího kontrolního úřadu, jeho organizační strukturou i samotnou kontrolní činností. Práce také analyzuje výhody i nevýhody jednotlivých pozic organizační struktury, zejména kolegia, viceprezidenta i kárné komory. Současná koncepce Nejvyššího kontrolního úřadu je založena na zkušenostech podobných institucí v jiných zemích světa. Tato koncepce splňuje základní principy a doporučení Limské deklarace INTOSAI, tj. mezinárodní organizace, která sdružuje nejvyšší kontrolní instituce dalších států světa. Nejvyšší kontrolní úřad spolupracuje zejména s dalšími nejvyššími kontrolními institucemi evropských států, sdružených v rámci organizace EUROSAI. Práce analyzuje postavení a působnost Nejvyššího kontrolního úřadu v porovnání s některými evropskými SAIs, se zaměřením zejména na pravomoci a možnosti uvalení sankcí či nápravných opatření v případě zjištění nedostatků. Koncem roku 2010 byl Parlamentu ČR předložen návrh změny ústavního zákona č. 166/1993 Sb., který navrhuje rozšířit pravomoci Nejvyššího kontrolního úřadu o možnost kontroly hospodaření s majetkem samosprávných celků. "Vzhledem k tomu, že zákon ukládá územním samosprávným celkům povinnost, aby svůj majetek využívaly účelně a hospodárně, mohou kontroloři NKÚ kontrolovat i tyto aspekty jejich činnosti. Kontrola ale neovlivní princip samostatnosti výkonu územní samosprávy a vydaná opatření NKÚ nebudou do jejich činnosti nijak zasahovat. " Práce analyzuje výhody a nevýhody případného schválení této novely Parlamentem ČR. Koncem dubna 2012 je na programu schůze Poslanecké sněmovny druhé čtení této novely zákona.

Abstract:

The existence of an effective and independent audit system has become one of the main prerequisites for the functioning of a democratic state. In the Czech Republic, this condition is fulfilled by the Supreme Audit Office, whose role is vested in it by the Constitution of the CR. This institution represents a non-substitutable element of the Parliamentary democracy as it is totally independent both of executive and legislative powers. This paper deals with the history of the Supreme Audit Office, its organizational structure and the auditing activity itself. It also analyses advantages and disadvantages of particular posts of the organizational structure, especially the Board of SAO, vice-president of SAO and Reproach Chamber. The present concept of the Supreme Audit Office is based on the experience of similar institutions in the world. This concept meets the basic principles and recommendations of the Lima Declaration of INTOSAI, the international organization, which associates independent audit institutions. The Supreme Audit Office cooperates mainly with other supreme audit institutions associated in EUROSAI. This paper analyses the status and field of action in comparison with other supreme audit institutions, and focuses mainly on jurisdiction over entities and sanctions imposed on the basis of audit conclusions. At the end of 2010 an amendment to the Act No. 166/93 Coll., on the Supreme Audit Office was submitted to the Parliament, proposing SAO´s jurisdiction over managing the property of municipalities. Taking into account the fact that municipalities are obliged by law to manage their properties efficiently and economically, the auditors of the Supreme Audit Office are also entitled to check these aspects of their activities. Nevertheless, the audit will not affect the principle of the sovereignty of municipalities in terms of territorial autonomy and the measures taken by the SAO will not interfere with it. This paper analyses the pros and cons of the prospective approval of the amendment by the Parliament. At the end of April 2012 the second reading of the amendment is on the agenda of the Chamber of Deputies.
