Legal aspects of trade disputes between China and Australia at the WTO

Abstract:

Existence mechanismu, který by reguloval vznikající rozpory, je proto nutností. V systému Světové obchodní organizace byl tedy vytvořen a aktivně funguje mechanismus pro řešení obchodních sporů mezi účastníky mezinárodního trhu zboží a služeb. I přes podrobnou a přesnou úpravu postupu řešení obchodních sporů se v praxi nelze vyhnout problémům. Podle dokumentů WTO mají všechny členské státy přístup k mechanismu řešení sporů, ale rozvojové země tuto možnost využívají mnohem méně často než rozvinuté země. To je způsobeno především tím, že nedostatek finančních prostředků a obtíže při hledání kvalifikovaných odborníků, kteří by se takovými případy zabývali. Aspekty těchto sporů jsou předmětem mého bakalářského výzkumu. Rozdíly v rozsahu úspor jsou obzvláště patrné. Zde je třeba být opatrný, protože jednou ze zásad WTO pro řešení sporů je zákaz diskriminace. Hlavním cílem mé práce je vymezit hlavní právní aspekty obchodních sporů mezi zeměmi na půdě WTO. Tohoto cíle jsem se rozhodl dosáhnout analýzou sporů mezi Čínou a Austrálií. Vedlejšími cíli jsou zhodnocení mechanismu obhodních sporů mezi Čínou a Austrálií, určit příčiny nedokonalostí systému a navrhnout praktická řešení ke zlepšení současné situace.

Abstract:

The existence of a mechanism to regulate the emerging contradictions is therefore a necessity. Thus, in the WTO system, a mechanism for resolving trade disputes between participants in the international market for goods and services has been established and is actively functioning. Despite the detailed and precise regulation of the procedure for resolving trade disputes, problems cannot be avoided in practice. According to WTO documents, all member states have access to the dispute settlement mechanism, but developing countries use this possibility much less frequently than developed countries. This is mainly due to a lack of financial resources and difficulties in finding qualified experts to deal with such cases. Aspects of these disputes are the subject of my undergraduate research. Differences in the extent of savings are particularly noticeable. Caution should be exercised here, as one of the WTO's principles for dispute settlement is non-discrimination. The main objective of my thesis is to identify the main legal aspects of trade disputes between countries at the WTO. I have chosen to achieve this objective by analysing the disputes between China and Australia. The secondary objectives are to evaluate the mechanism of trade dispute settlement between China and Australia, to identify the causes of the imperfections in the system and to propose practical solutions to improve the current situation.
