Formation of contract according to the CISG

Abstract:

Bakalářská práce se zabývá Úmluvou OSN o smlouvách o mezinárodní koupi zboží, známou také jako CISG nebo Vídeňská Úmluva. Dále se věnuje Principům evropského smluvního práva, známé jako PECL a Návrhu společného referenčního rámce, který je znám pod zkratkou DCFR. Cílem je objasnit jednotlivé fáze kontraktačního procesu v režimu Úmluvy a následně zkoumat podobnosti a odlišnosti s ostatními projekty akademiků – PECL, DCFR, jejichž cílem je unifikace mezinárodního smluvního práva. V neposlední řadě hledá bakalářská práce odpověď na otázku, v čem spočívají odlišnosti kontraktačního procesu v režimu CISG, DCFR a PECL.

Abstract:

Bachelor thesis deals with the UN Convention on Contracts for the International Sale of Goods, also known as the CISG or the Vienna Convention. It also looks at the Principles of European Contract Law, known as PECL, and the Draft Common Frame of Reference, known as DCFR. First aim of this thesis is to analyze the different stages of the contracting process under the CISG regime. Second aim is to examine the similarities and differences with other projects created by academics that aim to unify international contract law – PECL, DCFR. Last but not least, the thesis seeks to answer the question of what the differences of the contracting process in the CISG, DCFR and PECL regimes are.
