A Comparison of the Legal Regulation of the Licensing Agreement for Musical Works in the Czech Republic, the USA and Germany

Abstract:

Tato diplomová práce si klade za cíl zjistit právní podmínky ve vztahu k uzavírání licenčních smluv ohledně hudebních děl ve třech různých státech. Práce je rozdělena do dvou částí - teoretické a praktické. Teoretická část diplomové práce je postavena na otázkách, zda je tuzemská právní úprava týkající se autorského práva, a především právní základ licenční smlouvy o hudební dílo postaven dostatečně kvalitně a podrobně oproti dvěma srovnávaným zemím, současně je v této části zkoumána rozdílnost a shoda napříč právními úpravami s cílem zjištění, zda se lze v některých aspektech zahraničních úprav a podmínek inspirovat. Praktická část je věnována praktickému procesu sjednání licenční smlouvy k hudebnímu dílu v rámci podnikání, a dále komparace tohoto procesu s podmínkami v USA a Německu.

Abstract:

This diploma thesis is focused the legal conditions in relation to licensing agreements for musical works in three different countries. The thesis is divided into two parts - theoretical and practical. The theoretical part of the thesis is based on the questions whether the Czech legislation concerning copyright law, and especially the legal basis of the license agreement for musical works, is built in sufficient quality and detail compared to the two compared countries. In addition, in this part the differences and similarities across the legal regulations are examined in order to see whether some aspects of the foreign laws and conditions can be an inspiration for the Czech law. The main topic of the practical part is the real process of closing a licensing agreement for a musical work for retail purposes, and a comparison of this process with the conditions in the Unites States and Germany.
