Maintenance of a minor child under the legislation in Czech republic

Abstract:

Diplomová práce má poskytnout čtenáři komplexní přehled všech aspektů týkajících se výživného k nezletilému dítěti. Práce je členěna do šesti kapitol, kdy první kapitola se věnuje historickému vývoji institutu výživného. Převážná část práce pak poskytuje zhodnocení současné právní úpravy v České republice. Vysvětluje samotný institut výživného a rozebírá vznik, trvání a zánik nároku na výživné, převážně ve vztahu k nezletilému dítěti. Následně se práce zabývá určováním výše výživného a procesem vymáhání výživného. V poslední části přináší autor vlastní návrhy na zlepšení současné právní úpravy.

Abstract:

Diploma thesis should provide the reader with a complex overview of aspects concerning the maintenance of a minor child. It is divided into six chapters, where in the first chapter is focused on the historical development of the institute of maintenance. The major part of the work is then providing evaluation of the current legal regulation in the Czech Republic. It is explaining the legal institute of maintenance itself and analyzing the creation, duration and end of the maintenance claim, mainly concerning the relationship to the minor child. Subsequently is the thesis dealing with the determining the amount of maintenance and the process of prosecution. In the last part the author is bringing his own ideas for improvement of the current legal regulation.
