Vybrané právní aspekty podnikání ve zdravotnictví v oboru stomatologie

Abstract:

Tato bakalářská práce se zabývá povinnostmi poskytovatelů zdravotních služeb v České republice, které jí stanoví zákon, předpisy a legislativa pro podnikání ve zdravotnictví v oboru stomatologie. Cílem bakalářské práce je popsat vybrané právní aspekty tohoto podnikatelského zaměření, jejich úskalí výhody a nevýhody. Teoretická část definuje jednotlivé formy podnikání ve zdravotnictví, získání oprávnění k poskytování zdravotních služeb a další podmínky související s poskytováním zdravotních služeb dle zákona č. 372/2011 Sb., o zdravotních službách a podmínkách jejich poskytování. Začínajícím a budoucím stomatologům jsou představeny další zákonné povinnosti, kterým musí před zahájením praxe věnovat patřičnou pozornost. Zejména pak ve vztahu ke Krajské hygienické stanici, Státnímu ústavu jaderné bezpečnosti, volba lékaře mezi poskytováním zdravotní péče s účastí veřejného pojištění nebo bez pojištění s přímou platbou pacienta. Praktická část zahrnuje výzkum prováděný formou dotazníkového šetření, e-mail. Dotazník vyplnilo 10 respondentů, zubních lékařů, z různých krajů České republiky. Na základě odpovědí respondentů byla stanovena nejčastější a také optimální forma podnikání určená pro malá zdravotnická zařízení a také důvody těchto rozhodnutí. Praktická část dále obsahuje výzkum prováděný formou dotazníkového šetření 20 respondentů, veřejnost. Výsledky tohoto šetření byly použity ke srovnání stávajícího stavu zubního lékařství co do počtu zubních lékařů z pohledu statistiky a počtu lékařů na počet obyvatel, a z pohledu obyvatel vybraného regionu a jejich názorů na danou problematiku. Stanovený cíl práce byl splněn. Práce představuje výčet základních povinností poskytovatelů, které jim jsou uloženy zákonem. V bakalářské práci jsou zmapovány povinnosti poskytovatelů, se kterými se potýká chod každé soukromé zubní praxe. Zubní lékař je každodenně vystaven kromě samotné práce zubního lékaře i manažerským povinnostem, dodržování předpisů, zákonů a povinností vyplývajících z povahy podnikání. Práce může pomoci zubním lékařům v začátcích podnikání, manažerům v oboru zubní lékařství při jejich pochybách a rozhodování.

Abstract:

This bachelor's thesis deals with the obligations of health service providers in the Czech Republic, which are stipulated by law, regulations and legislation for the health care business in the field of dentistry. The aim of the bachelor thesis is to present selected legal aspects of this business, their pitfalls advantages and disadvantages. The theoretical part defines the different forms of health care business, obtaining authorization to provide health services and other conditions related to the provision of health services according to Act No. 372/2011 Coll., on health services and conditions of their provision. Beginning and future dentists are introduced to other legal obligations to which they must pay due attention before starting practice. In particular, in relation to the Regional Sanitary Station, the State Institute of Nuclear Safety, the choice of the doctor between providing health care with or without public insurance with direct payment of the patient. The practical part includes research conducted in the form of a questionnaire survey, e-mail. The questionnaire was completed by 10 respondents, dentists, from different regions of the Czech Republic. Based on the answers of the respondents, the most frequent and also the optimal form of business for small health care institutions was determined, as well as the reasons for these decisions. The results of this survey were used to compare the current state of dentistry in terms of the number of dentists in terms of statistics and the number of doctors per population, and in terms of the population of the selected region and their opinions on the issue. The stated aim of the thesis was fulfilled. The thesis presents the basic obligations of providers imposed by law. The bachelor's thesis maps out the obligations of providers that are faced in the operation of every private dental practice. The dentist is exposed on a daily basis to managerial duties, compliance with regulations, laws and obligations arising from the nature of the business, in addition to the actual work of the dentist. This work can help dentists in the beginning of their business, and dental managers in their doubts and decision making.
