Abstract:

Abstrakt Tato bakalářská práce se zabývá zásahy do základních práv a svobod v trestním řízení. Téma práce je aktuální a zajímavé, neboť v trestním řízení dochází k výrazným zásahům do práv a svobod jednotlivce. Trestní řízení v České republice prochází postupně velkými změnami v hmotném i procesním trestním právu. Novely trestního zákoníku přinesly změny v možnosti ukládání alternativních trestů. Jde o možnosti ukládání alternativní sankce k trestu odnětí svobody, která by měla také napomáhat k řešení problému přeplněnosti věznic. Novely trestního řádu upravily postup trestního řízení a mají urychlit a zefektivnit trestní řízení. Práce se zaměřuje na porovnání platných právních norem v trestním řízení, jejich soulad s Listinou základních práv a svobod a je zpracována na podkladě informací získaných ze studia právních norem a zákonů, odborné literatury a dokumentů. Cílem bakalářské práce je zjistit zda platné trestní právní normy jsou dostatečné a zajišťují-li ochranu občanských práv a svobod garantovaných Listinou základních práv a svobod, která je součástí ústavního pořádku České republiky. Vedou-li legislativní změny k upřednostnění alternativních trestů před sankcemi nepodmíněného trestu odnětí svobody a zda tyto změny mohou urychlit trestní řízení.

Abstract:

Abstract This thesis deals with encroachments into fundamental rights and freedoms in criminal proceedings. The topic of work is current and interesting, because in the criminal proceedings you can find many significant interventions into the rights and freedoms of individuals. The criminal proceedings in the Czech Republic is gradually undergoing major changes in substantive and criminal procedural laws. The amendments to the Criminal Code brought changes in the possibility of alternative sanctions. There is a posibility to impose an alternative sanction to the prison sentence, which should also help to solve the problem of overcrowding in prisons. The amendments to the Criminal Procedure Code regulated the method in criminal proceedings and should speed it up and make it more efficient. The work focuses on the comparison of the applicable legal standards in criminal proceedings and their compliance with the Charter of Fundamental Rights and Freedoms. The thesis is elaborated on the basis of information obtained from the study of legal norms and laws, specialized literature and documents. The aim of this work is to determine whether current criminal laws and standards are adequate to ensure the protection of civil rights and freedoms guaranteed by the Charter of Rights and Freedoms, which is a part of the constitutional order of the Czech Republic. It should also determine whether the legislative changes lead to priority the alternative punishments over the punishments of unconditional imprisonment.
