The legal regime of agricultural land

Abstract:

Tato práce nastínila problematiku vyjímání pozemků ze zemědělského půdního fondu v případě umisťování opěrných bodů nadzemního komunikačního vedení (anténních stožárů pro mobilní telefony) na zemědělských pozemcích. V první části jsem se věnovala nezbytným teoretickým podkladům – členění pozemků, pozemkům spadajícím pod ochranu zemědělského půdního fondu, způsobům jejich ochrany a možnostem vyjmutí ze zemědělského půdního fondu. Jako podklad pro praktickou část zde stručně nastiňuji problematiku umisťování nadzemního komunikačního vedení podle zákona o elektronických komunikacích a obecnou úpravu věcných břemen. Ve zvláštní části jsem se věnovala procesu umisťování opěrných bodů nadzemního komunikačního vedení (anténních stožárů) a analýze skutečných případů z praxe. Práce nastínila postup nakládání se zemědělskými pozemky, pokud jsou dotčeny výstavbou opěrného bodu. Protože se mění způsob využívání půdy a také její druh (zapsaný v katastru nemovitostí), je nutné pozemky vyjmout ze zemědělského půdního fondu. S tímto vyjmutím musí vydat souhlas příslušný orgán ochrany zemědělského půdního fondu (obec s rozšířenou působností, v jejímž katastru se předmětné pozemky nacházejí). Tento souhlas je nezbytnou součástí rozhodnutí, které uděluje příslušný stavební úřad podle stavebního zákona a jehož podmínky jsou v rozhodnutí zapracovány. Vyjímaný pozemek se také mj. musí oddělit od stávajícího zemědělského pozemku, protože se mění využití pouze relativně malé části pozemku (cca 150 m2). Příslušný stavební úřad vydává na žádost investora také souhlas s dělením pozemků. Před realizací stavby se s vlastníky pozemků uzavírá smlouva o smlouvě budoucí o zřízení věcného břemene, po realizaci se uzavírá smlouva o zřízení věcného břemene. Přílohou smlouvy o zřízení věcného břemene je mj. geometrický plán s přesným zákresem situace – včetně rozdělení pozemků a umístění opěrného bodu, příjezdové cesty, oplocení, elektro přípojky. Na základě návrhu na vklad podaný účastníky řízení zapíše příslušný katastrální úřad nově vzniklý pozemek se změněným druhem pozemku včetně věcného břemene do katastru nemovitostí. Cíl práce byl tímto naplněn.

Abstract:

This thesis deals with the legal system of agricultural land – a topic very extensive and complex that can be approached several ways. I decided to build on my real-life experience. I work as a specialist on property management for one of the providers of cell phone services and I also deal with the problem of allocating the antenna masts for cell phones. These are sometimes placed on agricultural land which must be excluded from agricultural land fund. The placement of the masts on the land is often based on Easement Agreement which is put in the real estate register. My thesis is divided into two basic parts – the general one and the special one. In the general part I focused on the necessary theoretical basis and the theoretical part also includes the relevant jurisdiction. In the special part I focus on the process of placing the masts, especially on excluding of the land from the agricultural land resources. In the general part I first present basic terms used later in the thesis. I briefly explain the categorization of the land in the real estate register and I also mention the simplified registration mode. I also speak about the Land Fund of the Czech Republic which manages the agricultural and forestry land being owned by the state. Then I go into details of the agricultural land fund – which land is part of it and how its protection works. The protection of the land fund can be either quantitative or qualitative. In our jurisdiction the quantitative one is more frequent – the state regulates the amount of land being excluded from the fund. The qualitative protection focuses on the land quality, trying to protect the health and lives of people and other living organisms. In the general part I also present the reader with a brief introduction of the matter of allocation the aerial masts and easement. In the special part I focus on the process of allocating the antenna masts including the building regulations and excluding the land from the agricultural land fund. This process ends with signing the Easement Agreement, based on which the easement is put in the real estate register. I also include two case studies of interesting cases concerning this matter. The aim of this work was to present the reader with the issue of excluding the land from the agricultural land fund while allocating antenna masts for a cell phone provider on agricultural land. My thesis outlines the ways it is possible to work with agricultural land in the case of building an antenna mast. Because this changes the way the land is being used and also its categorization, it is necessary to exclude it from the agricultural land fund. This must be confirmed by a relevant authority of agricultural land fund protection (the concerned urban area). This confirmation is an obligatory part of the decision given by the Construction Office according to the building regulations. Its conditions are listed in the decision, too. The excluded land must be also marked off the existing agricultural land, because only a small part of it is actually changed in the way of using (approx. 150 square meters). The Construction Office also issues the agreement with dividing the land based on investor’s request. Before starting the construction a letter of understanding about the Easement Agreement is signed, followed with the Easement Agreement itself after the construction is finished. The Easement Agreement is also supplemented with a geometrical plan showing the situation in detail – including the division of the land and the placement of the mast, access road, fencing and electric connection. Based on the registration proposal presented by the parties concerned the real estate registering office enters the newly created land with changed type including the Easement in the real estate register.
